Video: Drunk big biker mows down policeman at checkpoint - faces eight charges

A 28 year old big biker is facing eight charges after he hit a senior policeman at a checkpoint near Central Westgate in Bang Yai on the outskirts of Bangkok. 

 

Bang Yai police had set up the checkpoint on Friday night to stop road racers and the incident occurred at 12.40 am on Saturday when Pol Lt-Col Weerasak walked out with his torch and ordered the rider to stop. 

 

He slowed down then revved his 650 cc Honda CBR colliding with the officer who suffered a head injury that required emergency brain surgery at the Police Hospital. Weerasak remains in ICU. 

 

The rider was caught at another police checkpoint set up by the Bang Kruay police further down the road. 

 

Akkharin, 28, was found to have an alcohol level of 131 mg, nearly three times over the limit. 

 

He was denied bail and ordered held by the court on eight charges.

 

They were dangerous driving, injuring a policeman, drunk driving, refusing to stop for an officer, fleeing the scene of an accident, having no licence, having no plates and having no Thai ID in his possession. 

 

Bang Yai station chief Pol Col Suraphot Rortbamrung said that his injured colleague was a diligent and likable officer who he hoped would soon recover from his injuries and be back on duty.

Let's hope he doesn't have the money to buy his way out of it. Time that really heavy sentences start getting dished out to people who drive around pissed out of their minds. Should slap him with an attempted murder charge too.

Thailand does not understand the fundamentals of law enforcement and punishment 

 

Those that break the law (including moving traffic laws) run a risk reward assessment

 

Risk - How likely am I to get caught and if I am caught - what penalty will I face.

 

Reward - (does not always apply to moving traffic laws) proceeds of the crime

 

Until Thailand gets this fundamental understanding then nothing will improve 

 

 

Here is a thought - Suppose from tomorrow the UK announced that police would no longer enforce the road traffic act effectively allowing motorists to do exactly what they wanted without the risk of prosecution - what would happen ?

 

- In a very short time we would have the same carnage on UK roads as we have in Thailand right now.....maybe even worse, yes some sensible people would still want to comply with the law because they know it is the right thing - but many wouldn't and it would get worse over time

it would be very difficult to prove his intention was to kill the officer unless of course he made that intention very clear beforehand 

 

not the same as pointing a gun at someone and pulling the trigger

I am sure a good prosecutor could make a case that pointing a large 650cc motorbike at a person and gunning it in that persons direction it tantamount to premeditated murder.

Yes, you have a brain lets hope they have that rule of law and some good prosecutors to file and pursue that charge.

Hope he does some serious uncomfortable prison time.

At least, being Thai, in addition to the eight charges, he'll not have to worry about filing a TM.30 when he returns home from jail...

Somebody was reported being drunk on thai visa a few days ago where by a person died and the judge gave a 100,000 baht fine. So being 3 times over the limit and crashing into police might only be 3 wai's and a 500 baht fine about the same for beating up a foriener. Thank you for thai visa for reporting these incidents. Nothing will ever change. When i sat through the 1 hour video a few forieners watched the video but sime of the others go to sleep, talk on phones texting, even go outside to take a call. Nobody checks to make sure video is looked at.

No, not really. Would have to show he was intending to murder the officer. No indication AFAIK.

 

Negligence, grievous bodily arm. causing serious injury etc etc etc. But attempted murder would be pushing it. 

 

Bare in mind that in cases where the unfortunate victim has died, murder charges aren't brought.

Not sure if you read the article correctly?  the article noted the biker slow down or stopped rev his 650cc engine prior to hitting the officer, you do know in the west at least a vehicle is consider a weapon the reason the police blast the shit out of drivers who use their cars to try to run down people or police. Although a bike a human being can't defend against steel even a bike going at speed greater than walking!

Last year, my home State, a guy on a Mountain bike ran a red light intentionally and hit a pedestrian while he was crossing the street in the crosswalk clipped him slightly the guy lost his balance and fell cracked his head on the sidewalk and died!  Biker got manslaughter!  You don't need a gun!

It’s already happening. There are very few traffic police about now. I was driving there last month and I was shocked at the amount of red light jumping, speeding and cars parked wherever anyone felt like it.

These aggressive'' harassment officers'' at check points ( which have nothing to do with the rule of law, its all about the cash), are out of control.....Stand down a bit..if you were truly serious about enforcing the law and making this nation a better place, if you truly respected your badge....then things may change ,but many of us know who the real criminals are in Thailand..

no it isn't, no more than a baseball bat, they become weapons based on usage, a gun is a weapon by design

 

as I explained earlier - it is all to do with intent and being able to prove it

 

for example - if the motorbike rider actually purposely steered at the police officer (or any person for that matter) then there might be case, but if the police officer stepped in front of him then very hard to make a case for attempted murder - it is all to do with "intent"

Heaven knows what brain surgery involves. Head injuries take time to recover. We all wish him well. This motorcyclist should lose his license if he's got one. Does that happen here ?

Video shows the policeman walking out into the middle of a three lane highway, probably trying to kick the rider off his bike, not that great an idea as it turns out.
