future condo builds from the land registry

Hi

 

is it possible to find out from the land registry,if there is plans for a future condominium or house,on a certain plot of land.?

Facing my condo they have just removed mature trees and levelled the ground and planted saplings,but i am wondering whether

there is a future build planned on the plot.

If you are talking about accross from Lumpiniville in Naklua, then I am told that banana trees have been planted and a watering system has also been installed. Before the trees were planted I heard it was going to be a new block of condos.

And even if an owner / a developer has plans for a certain plot, there's no guarantee that it's all been recorded at the LTO or anywhere else.

 

Further there's plenty of ruthless, rich and powerful developers in LOS who decide to build condos and whatever and just go ahead and start with no approvals and no intention of getting approvals or permits and if really needed pay bribes to get them. examples:

 

- The hotel built on Soi Ruam Rudee, breaks many law and regulations. The owner/developer has been told many time to stop constructions etc., all ignored.

 

- The condo built right across a soi in Suphan Kwai, developer classic example of 'I do what I want, I don't care about rule or what affect my building has on other people. etc. 

 

- Several gated villages built in Pattaya/Jomtien etc., turned out the developers didn't own the land, etc. 

 

- The giant Tower near Jomtien Beach (never built) entangled in breaking numerous laws.

The Land Office will not know of any plans to build a condo until they are approached to issue condo title deeds. This will happen after all approvals and permissions have taken place.

 

The first people to know will be the District Office as they will have to approve an Environment Impact Assessment (EIA). After that a building permit needs to be issued from either the District Office or the Engineering Department.

 

Enquiries at the District Office will yield the fastest results.

There's no proper town planning, no enforcement of town planning laws here.

Hmmm.....

Under section 15, paragraph iv of the Planning & Zoning Act 2003 there is a complete breakdown of envelope sizes & weights according to how wealthy & foreign you appear to be.

Opposite side of the road from my condo they have cleared the land to build a condo... given location I would bet on IDEO... they knocked down about half the houses, leaving one row at the main road (which are barricaded off with metal sheets as if waiting to be demolished), then everything stopped. From what I can tell they bailed out when COVID arrived and economy tanked. The condos around that one offered 50% off to close the projects, so it would be unlikely in economy like this for a new condo to start being built from scratch. If already being built, they may press on, but if other than buying land nothing was done yet, and with tax on idle land biting, I'd guess the land would be quickly turned to something else to avoid taxes and losses of building new condos. At least for some years to come I think you don't have much to worry about.

sapling are probably land tax avoidance to get the land to be taxed as 'agriculture use' instead of empty which cost higher

so, if they feel that it's worth hiring people to plant things, they won't commence building anything for the short while

Many vacant land plots has seen banana planted on them. Reason is simple, with the new land and building tax into effect, empty, and thus unused land is higher taxed then "farm"  land . Can be seen everywhere, Thepprasit plots, Jomtien ..It is just done to get a lower tax bill

Exactly. 

 

It's not just land use, it's the use of existing buildings as well, even condo's.  

 

Look at all the residential condo's in Pattaya that are no short term holiday rentals to tourists, particularly Chinese.  They have 10 in room and pack out the condo's swimming pool and facilities.  The condo block effectively becomes  hotel.

 

Totally illegal, but allowed to happen because connected Thai's have invested in condo's here and can't sell them, and can't rent them to long term tenants.  Bad luck if you bought a condo in the block, or own a small hotel or guest house business.

Interesting.... my neighbours have become very noisy and I am thinking of selling cheap to a pig farmer, so no issue eh?

Totally agree.

I stay in East Pattaya and there is a vacant plot of about 1 rai next to our house. Was always a bit concerned as to future plans and the impact on our, thus far, very quiet location. 

A week or so back a digger turned up and was doing some clearance work plus they fenced off the side adjacent to the public road. So, I thought, here we go.

 

Looked at the plot this morning and they have planted rows of saplings. I couldn't be happier, for now...........
