Changing from family extension to Education extension (Non O visa)?

A Non O visa (expired), with a 12 month extension based on Thai spouse.

 

They are starting a 4 year degree course at a university.

 

Can their next 12 month extension be easily done on the basis of education? (The full year of uni will already be paid and they'll be half way through a semester)

 

Will they need to switch from an O visa to an Ed visa before they can get a 12 month extension based on Ed? 

 

Or is it easy to get a 12 month extension for Education on an expired Non O visa? With a proper uni course, not some language center or muay thai gym set-up.

Yes, they can just apply for an extension based on studying at a university.

Friend's brother could not at other institutions (Muay Thai gym) at immigration (unless for 20,000thb), and they had to fly out of the country and get a Non-Ed before returning, as an extension for Education could not be granted on another visa type.

Clearly I'm missing something.

He has Thai spouse.

They wish to attend university.

The only permission of stay required is for him.

Why doesn't he stick with Extension based on marriage to a Thai. Has simple easy financial requirements and just attend university.

I think currently you can change to extension based on ED if it's a university course without exit Thailand.

Because extensions for studying at an informal institution may not exceed one year of total stay in Thailand, for a fee this limitation is ignored by immigration.

When studying at a formal institution, like a university, there is no such rule.

And yes, you can't change non-immigrant visa categories, but it's also not required. All of the long term extensions require the applicant to have a non-immigrant visa, doesn't matter which one. So somebody who has a non-ED visa could for example apply for a retirement extension if he qualifies.
