I'm making a new topic following another one I just made regarding visa.

So I will explain again the situation, I was on non O with work permit but I could not renew my non O and went on visa exempt, I stopped to work, but I didn't cancel my work permit, I didn't know I had to. My company paid me to stand by, I think even this should not. So now I want to make a proper resignation, get a proper visa and then come back.

I should have stopped on 17 December, date I got my visa exempt. So how do I cancel my work permit now, I need a letter from my employer and when should be the date of resignation?

 

I'd ask if the expiration of the non-immigrant visa cancelled out the work permit automatically.

Would it be a good thing? I don't think they even know that my visa is expired. \

Right now I think I have to ask my employer to make a letter to lay me off dated before the I got the visa exempt and accept to pay 20 000 bahts.

I would think it should be the responsibility of the company to cancel your work permit. And also any charges if they do it too late.

Let them handle it, and pay for it.

If you are still receiving salary from your employer, albeit half as you are on standby, my opinion is that you are still employed and accordingly still need the work permit. Your employer should be able to assist you on this by contacting the relevant Thai employment office 

The royal decree a few years ago put the onus on the employer to notify the Labour Department within 15 days..

I know this as I tried to cancel a work permit back in 2021 but was turned away, they were not interested..

I still have the old work permit book and had since received a digital work permit.

I don't think you have anything to worry about.

No, The immigration and labor office database aren't linked and you have to do the WP cancallation seperate.

Correct, as he still receives money from the company it is regarded work and needs a valid WP.

The employer or the employee shoud go to the labor office to cancel the WP.
