Is another TM.30 required from my condo landlord if I stay in a hotel overnight?

Hello, I have a question regarding the TM.30.

I have a 2 year lease on a condo.  I received a TM.30 from the landlord when I moved in. 

 

My question is:  If I stay in a hotel for one night, must I contact my landlord in order for him to submit another TM.30.

I'm going to travel to Khao Yai this weekend.  I know the hotel will file a TM.30 as I'm a foreigner staying in their province for a couple nights.

 

I'm glad I don't have to contact my landlord upon my return to Bangkok.  I do recall the leasing agent telling me that the landlord will need to file another TM.30 if I travel.  Maybe she meant if I travel out of the country.

 

Another Question:   Does my landlord need to file another TM.30 if I travel out the country, say for one week?

In recent times there has been issue with TM30 after travel abroad.

Immigration was/is trying to sync TM30 with online reporting so wanting first 90 day report after travel abroad to be done in person.

 

IMO it's a big mess. The changes made to TM30 rules in June 2020 have been pushed aside.

Full circle back to TM30 required after travel abroad.

And then....reports of turning up to do new TM30 and immigration saying ....."returning to usual place of residence TM30 no need!" 

 

Are you doing annual extensions?

I'm staying in Thailand under an Elite Visa.  I did my first 90 day report last week.  No problems.

 

I just don't want any surprises 90 days from now.  I'll guess I'll use the same TM.30 three months from now regardless of checking into hotels as I travel within Thailand. 

 

I'll give myself one week of padding for my next 90 day report in case there are any issues with immigration.

When I did my annual renewal at Phuket Immigration in December they picked up that I had stayed in Ranong for a couple of nights and did not get an updated TM30.

 

They asked me to contact my landlord and get a new one there and then.

My online 90 day reporting was rejected because Immigration had a different TM30 notification from my condo address… It was because I stayed a couple nights at a B&B while visiting Sukothai… 

 

I had to have my condo reissue a new TM30 to reset it back to my condo address of over 5 years…

This is probably office-dependent so I think most would recommend asking at the Imm office, or state which one in hopes of getting an office-specific response.

 

The issue MAY be that leaving the country and returning to the same address does not result in a 'new' TM30 being filed as it might with a domestic hotel filing a new TM30 for you. So returning to the same address after an int'l trip leaves an accurate, valid TM30 in place.

 

If I think a new TM30 was filed by a hotel on a domestic trip I would absolutely file a new TM30 after returning to my 'permanent' address. 

 

And I would ask what CW's policy is when returning to the same address after a int'l trip.

This is why I have my wife do the check-in process whenever we travel locally, without any info from me, and nobody has asked yet.....so no need to worry about TM30's. But I still get hit for them when travelling outside of the country, no way out of that, they (Nonthaburi Immigration) insist they want a new one when I get back.

I think it depends if the hotel actually files a TM30.  I've had both situations - stayed one night in a hotel and next online 90 day declined, stayed a week in a hotel and had next online 90 day approved.

 

However, the slight twist may have been that for the week's stay, I checked in using only my Thai license - and that license had my expired passport number on it.

I'll have my wife do the check-in while I stay in the car.  If they do need my info, passport or driver's license in order to check-in, then I'll request a new TM.30 from my landlord when I return back to Bangkok.

 

It appears that the Thai immigration system records the last reported address.  If I'm reported outside the province, then that can cause some surprises when I do the next 90 day report in Bangkok.

 

Question:  I live in Bangkok.  What if I'm out late one night in Bangkok and I decided to spend the night in a nearby hotel rather than travel home after midnight.  I assume the hotel will send a TM.30 to immigration.  Do you think this will be a problem with Bangkok immigration?

Just my experience with CW.

I never do a TM30 after travel.

In last couple of annual extensions I have obtained new TM30 just prior to application for extension.

For TM47 ...I opt not to do it in person. After trips abroad I do it via mail.

I travel in and out of the country at least 3 times a year… When in country we do weekend getaways once or twice a month… So my TM30 is constantly being changed… I have given up on online 90 day reporting… Luckily here in Chiang Mai they have a nice drive thru at immigration that takes a minute or two if there is no line they do not question/compare the address on the 90 day report to anything the computer says… I don’t bother trying to keep the TM30 updated thru out the year… Once a year I ask our Jurassic person at the condo to issue a new TM30 a few days before I hand over my passport to me agent who handles my annual extension….

It always depends on the immigration office that you use  and even then, it can be different depending on the individual immigration officer that is serving you.

I always do a new TM 30 report after I have stayed anywhere else.

I have lived in the same house for the past 24 years and sometimes I am asked to do one and sometimes not.

I find it easier to always do one now.

I'm going to summarize what I learned so far:

 

1.  Most likely, immigration won't check to see if the TM.30 you provide for the 90 day report matches with what's in their computer.  But there is always the chance that an attentive officer will notice the discrepancy and not let it slide.

 

2. When doing the annual extension, most foreigners take the time to make sure the TM.30 they provide matches with the immigration computer's records.

 

3. If you own your own home, you can file the TM.30 on your own behalf since you are both the owner and the foreigner.  The simplifies the TM.30 since you are not dependent on another party to file the report.

 

4.  Since I am staying on an Elite Visa, I don't get the benefit of the annual extension.  #2 doesn't apply to me.  I have to leave the country every 365 days and upon my return, my landlord must submit another TM.30 to immigration. 

 

One of these days, I'll purchase a small condo.  This should simplify reconciling what's in immigration's computer database and the TM.30 I submit for my 90 day report.

Actually like your summary.

Don't follow last point re buy condo.

By all means do that if suits your wants. 

However just for TM30 etc forget it.

This conjecture may apply for in-person TM47 filing.

 

For online TM47 filing, there have been many, many first-hand reports of rejections for a mismatch with the current, valid TM30. See BKKKevin's post above.

I had a 90 day rejected due to a 1 night hotel stay locally. CM immigration said I didn’t need one, but I’ve just made it a habit of filling one out online after any nights away. 
 

Just makes life easier and I don’t have fight city hall where everyone has a different rule

Instead of starting a new thread, I have a related question. I just moved into a small shop house attached to my wife's business. My wife isn't the landlord. An extended family member is, so I need to know what docs. I need to register as a guest. I'm most likely only staying a month, but if I'm not registered somewhere during my stay, immigration may question me when I leave because they'll be no record of a TM30.

The only time you would (perhaps) require a TM30 is if you need to have dealings with immigration.

For example to obtain an extension etc.

Even then a TM30 is not necessarily required.

Immigration sounds like they just want 1. TM30 from wherever you stayed in the last 3 months or 6 months so don't require one for every place

The trouble starts if a 3rd party such as a hotel files a TM30 notification for you that "overwrites" the one you had filed for your regular/permanent residence. Especially if that is a place that is outside of your immigration office's jurisdiction.
