Hi everyone,

I would like some advice please

 

My friend a fellow expat from the UK died in Thailand in  early October of last year 2024, i myself was named as a beneficiary in his will along with his partner, he named his sister from the UK as the executor.

 

The will went through probate and the executor paid out the inheritance according to my friends  wishes in April of this year 2025.

 

My wife received a text message today 16th of September 2025, from the solicitor  saying  that my friends partner owes him fees and has blocked him on the phone, he is stating that he is going to revoke the will through court unless he receives monies owed by the partner.

 

what do you think

The solicitor is just trying it on. once the will has gone through probate an distributed that is it. this sounds like the solicitor has not been paid, and should be using the small claims court or similar to reclaim costs, i would keep all records of what he says, and make a complaint to the law society or the body that regulates solictors ,it is important not to be abusive or make threats

Indeed, it's a simple debt you can't just cancel someones will over an unpaid invoice. Hilarious that he thought you or anyone else would fall for it.

The solicitors fees should have been deducted prior to paying out the inheritance, contact the executor and ask the story

 Sorry i forgot to say that this  all happened  in Thailand . The partner has blocked all  correspondence with the solicitor and ourselves so i have no idea why he should owe money to the solicitor.

 

My inheritance   was paid out to myself a few months before the partner received  theirs,  different banks and a much larger amount  i presume.

     All expenses, fees, taxes, debts, funeral costs, and anything else the deceased owes should be paid out before any remaining monies and property are distributed to the benefactors.  A well-written Will should contain a clause that spells this out.   It is the executor's responsibility to carry out the terms of a Will, not a beneficiary named in a Will.  An executor can, of course, also be a beneficiary.
