Work Permit cancelled, what about Non-B

Hi All, 

 

A foreigner has a work permit and a Non-B work visa. 

If the work permit ends or is terminated, what happens to the NON-B, visa is it cancelled or does it continue as valid until expiry?

And this is where correct terminology comes into play. 

If you were on the initial 90 day stamp from a Non-B visa (gotten either inside or outside the country) and your work permit was canceled or you stopped working, you could stay for that 90-day stamp. 

However 
If you were on an extension of stay that you got at the immigration office based on employment from a Non-B visa, as soon as your work permit would be canceled your extension of stay would need to be canceled as well. 

That's because holding a valid work permit is a criteria for continuing to keep the extension. 

You would need to take termination paperwork to the immigration office and cancel the current extension you're on. Then either apply for a different extension, or buy a 7-Day get out of Thailand stamp for 1900 and leave the country in a week. 

You cannot stay until the extension runs out that is not how it works...

Could you just leave the country within a few days of the wp cancellation, and then come back in later as a tourist, or with a new visa from a consulate overseas?

You would be a few days on overstay.

If you're on an extension of stay you could indeed exit the country and the officers at passport control would not know your work permit was canceled previously. 

 

The problem you will run into is if you ever want to work here again. That's because you will have an "open" (uncanceled) extension in your passport. That means you couldn't get a new non B visa at the immigration office or an extension (if you got a non-b outside the country) until you cancelled the earlier "open" extension <- keep in mind stamping out doesn't officially cancel and extension. You'll get fined 500 baht a day for every day you didn't cancel it, up to a max of 20k baht.. 

 

So as long as you don't want to work here anymore, you're fine just leave. You could come back free stamp or on a tourist visa with no issue.

 

The issue with "open" (uncanceled) extensions based on employment only comes up if you go to work inside the country again.
