TM30 and 90 day reporting - Jomtien Immigration

On a DTV which gives you up to 180 days in the country:

 

1. Is it still the case that you have 72 hours to go to Jomtien Immigration to lodge a TM30 once entering the country? Is the timeframe still within 72 hours?

 

2. If you don't need to go to Jomtien Immigration to use any of their services during the 180 days you are in the country, will there be any problems if you just skip doing the TM30 and 90 reporting?

 

3. Say the next time you enter the country after this you go to do a Jomtien Immigration to do a TM30 & 90 day report because you need to get a Certificate of Residency to renew a 2 year licence for another 2 years, will Jomtien Immigration look over your history and fine you for previously not doing a a TM30 and 90 day report during your previous entry?

 

 

You should do a TM30 and a TM47 as per the requirements. 

Some will state that not required if always plan to exit every 180 days or less. 

However the moment you need to obtain something from immigration such as a COR, transfer stamps etc then there's an issue.

The law says TM30 must be filed within 24 hours of arrival.  Obviously the immigration office is not open on weekends, but I would wager 99% of TM30 are done online now anyways which is always open.

TM30 is required if you want to avail immigration services. I can't think of any reason why one needs immigration services on a DTV visa.

#1. Person with a DTV may not wish to exit/reenter Thailand to obtain 6 month stamp. 

They may wish to obtain extension at immigration. 

#2. May need dealing with immigration for eg a COR for various reasons. 

Both would require a TM30

For the past five years I have never updated my TM30. Needed a COR for purchasing a MC. Refused at the immigration because I have not updated my Tm30. Went to an agent and paid 500 baht for a COR from the immigration without any TM30 update. Where there is a will, there is a way.

Why are you so averse to updating your TM30.......presumably there is a reason.

My address never changed in the five years. Immigration always have my most recent address and can locate me anytime they want. I did not feel there is a need for TM300 filing.

But you understand why Immigration thought differently - and they make the rules.

True, but I they are useful in that they confirm that some Immigration offices will not issue a COR without an updated TM30. It is useful for readers to understand that requirement  -  and that agents offer a plan B.

Since COR is not an official TM form the requirements can vary even more than usual at various immigration offices. 

Added to that some offices (jomtien good example) can flip flop on their need for TM30.

100% true, exactly what I experienced within a 6 month period at Jomtien - one occasion they required a TM30; on my second return they said it wasn't necessary  - on both occasions I returned to the same address.

Most recent reports regarding returning to Thailand with eg reentry permit to ongoing place of residence a TM30 is not required at Jomtien. 

Nor should it be.

For curiosity purposes, which agent? You can PM me the details if you don't want to post here 🙂

 

So it only cost you 500 baht rather than a 1,600 baht fine from Jomtien Immigration, having to do a TM30 and 300 baht for a Certificate of Residence. A saving of 1,400 baht and your time saved too. Wonder if this will work with a DTV too if you never did a TM30 on your recent entry but did one a few entries prior, and if you just tell the agent that you stay at the same address, even if you change rooms but stay in the same condo building?

There is no fine unless you changed address and did not notify (TM-30).  If at the same address, there is no fine - just a pointless waste of your time + possible hassle to get new landlord-docs.  This exercise is nothing other than punishment for not using one of their agents to handle your affairs at their office.

 why not use one their agents for all you immigration business. It helps lots of people who are unfortunate to earn in dollars

I did not break any rules. I got my COR without any TM30 update. I upheld the sprit of the rule for the immigration to be able to locate me whenever they want because they have my most recent address.

No. You paid an agent to break the rules.....the rules told you to go and fornicate.

 

Don't misunderstand me; there is nothing "wrong" with that because that is the system that prevails in Thailand  - but, please, don't claim any moral high ground.

I'm on a marriage visa and this is what happened for me in Bangkok when I returned from a visit to the US - they waived the TM30.

A bunch of people before me were being turned away because they didn't have one, but I'm not sure of their circumstances.

I'm claiming moral high ground because paying agents and IOs in immigration helps lot of people who are unfortunate to earn in dollars.
