DOJ Reverses Itself, Says Comey Grand Jury Saw Final Indictment

 

The prosecutor hand-picked by President Donald Trump to pursue a criminal case against James Comey now says the indictment of the former FBI director was properly presented to a grand jury for a vote — a day after telling a judge the final version of the charging papers was never shown to the full jury.

 

But lawyers for Comey said in their own filing Thursday that multiple irregularities in how the indictment was handled provide for a basis for the judge to dismiss it “based on the government’s misconduct.”


“The litany of errors that have surfaced just in the last week warrants close inspection” of Halligan’s conduct in the case, Comey’s attorneys wrote.

Prosecutors attempted to clear up confusion about the proceedings and, pointing to the transcript of proceedings when the indictment was returned, wrote in a filing Thursday that the foreperson told the court that the grand jury voted on the two-count indictment.

 

"The complete record eliminates any doubt: The foreperson confirmed the vote. The Court acknowledged the vote. The Court docketed the two-count true bill as the operative indictment. Only Count One lacked concurrence; Counts Two and Three were true-billed by at least twelve jurors," they said. 

 

But in their latest bid to dismiss the charges related to the alleged grand-jury issues, Comey's lawyers argued that "there is no record of the grand jury seeing the new indictment — let alone voting on it." Prosecutors' "late-breaking" effort to correct the record "cannot save the putative indictment," they continued.

 

Their filing, defense lawyers said, "contradicts numerous other representations that the government has made to this Court. And it rests on an erroneous overreading of an ambiguous exchange between the grand jury foreperson and the magistrate judge."

I was watching Megyn Kelly a former lawyer & her panel of legal  experts . Comey is attacking the 4 corners of the indictments. Kelly said she got reliable sources that this is all gonna be cured. If you cant win on the facts you attack the prosecutor ,the judge has issues ( judge asks the defense if the prosecutor is a Puppet).

The problem with this video is the same one that has plagued the indictment from the start. Comey replied to a question from Ted Cruz about whether he authorized Andrew McCabe to leak. Which Comey denied. But the prosecution in its push for inidictment made it about Daniel Richman instead. Which is a lie.

 I've read Andrew McCarthy on this. He's been very critical of the halligan prosecution. But he thinks that because those two indictments were originally present in the document that was approved by the jurors, the judge will probably rule that it's okay. It's a mark of their incompetence, but it doesn't rise to the level of disqualification is how he puts it.
