Should Non-O and work permit validity periods match?

Featured Replies

Hi everyone,

I’m staying in Thailand on a NON-O (Thai wife) visa and will have to apply for a work permit soon.

What I’m curious about is:

1. Can I apply for a work permit with a NON-O visa?

2. Does my NON-O visa expiration date need to match with the work permit? My visa expires somewhere in July, but will apply for a work permit in January. Does that mean I would also need to renew my Non-O visa in January, so my visa matches the validity period of the work permit?

Many thanks in advance.

Your visa/extension has nothing to do with your work permit, you have an extension because you're married to a thai not because of employment.

The two (marriage extension & work permit) won't sync up and it doesn't matter in the least.

You'll apply for your next extension when you have 30 days or less before this current one expires

Thank you very much, Tod Daniels and DrJack54!

It makes sense that my visa and work permit have no influence on each other.

Sorta. Keep in mind tod Daniels post above.

You are married so that makes a difference to non married to Thai.

I for example not married would require a Non B.

Different requirements.

Ahh yes! I guess your Non B would be cancelled the day your work permit expires. If I’m not mistaken, you will get 7 days to get your new visa in order or leave the country?

That’s one of the reasons I’m glad I can apply for a work permit with a Non-O.

Thanks for the info, DrJack!

You get 0 days to leave.  Unless your company is a BOI company, the permission to stay is invalid as of the day work stops. There is no grace period.

Believe it or not, many MANY employers really pressure their employees to get off Non-O marriage visa/extensions and go onto Non-B's

That way the employer has "control" over your ability to stay and if you quit you lose the extension

Whereas on a Non-O visa/extension you're ability to stay is not tied to your employment and if you lose or quit your job your stay isn't affected..

In fact, some employers won't even hire people who refuse to get off marriage extensions just because of that "lack of control".. 😕
