Hi there I’m currently working as sales management for an automotive company here in Thailand.

recently purchasing management have left the company for family reason

and the company will not hire replaxemwnt

but basically told me to take care of purchasing section as well.

 

there’s too much additional work as purchasing, so according to Thai labor law, as my job description is basically sales management related, 

I could tell my employer no i will not do it?

 

Company can’t sack me for that right?

Refuse to do the job, let them fire you, pay the adequate compensation and after the payout take them to court.

 

My wife was in similar position and did just that.

Is that really in Thailand? I thought when the company pays the dismissal compensation of around six months pays, there’s no more legal obligation attached  to them 

They may be trying to get you to leave by giving you too much work. Start looking for another job, getting fired and going to court is messy

I would be very worried to be legally married to someone like that, hopefully you wont ever divorce

Getting fired for illegitimate reason is not messy. Several months severance pay will compensate any kind of mess.

It is normal for family companies to add extra work if they think you are competent. My experience has been that running 2-3 departments raises their trust in you. I believe that the better you are the more work you will get.

If it is too difficult, telling them politely that you will need some help. Hire an assistant.

They can give you notice if not happy with you and give compensation but your work permit is cancelled and you may have to leave the country and come back as a tourist - if you don't have another job lined up or have permanent residence.

I think I could actually handle but it’s not rude for asking a pay rise due to handling additional department?

Your actions really depend on whether you want to keep your job or not.

 

There is the AN way of doing things and then the correct professional way.

 

If you are happy in your job then you need to implement discussions on how the extra work will be allocated and if there are any additional resources available, be it another headcount costing less than the Purchasing Manager or other current positions that can help with the extra workload. A Multi-National would probably expect this approach and i'm surprised they have not suggested this.

 

Regarding leaving, it's a bit of a grey area in that Labour law states that if your new position is very different from your current position then the company has to give you the choice to accept the position or move on with an agreed severance package. The grey area is whether you both agree on the job role being so different.

several months is nothing especially if it takes months to get another job or maybe no job

I'm not sure it's better to slavishly accept without compensation any out-of-scope duty from an employer for months/year until a new job is secured (or maybe never as you say).

You could try asking but be prepared to say no problem if they say they can't afford it at present. All companies seem to think people won't leave.

Download theLabour Protection Act B.E. 2541.

Indeed, they may fire you, in that case according to the number of months/years you have been working there, they have to pay severance.

I’ve skimmed the labor law under section 118 but doesn’t have details on reason for termination from employer side.

means they do not have to give reasons to terminate and just pays the severance?

3-6minths pays isn’t much… compared to find a new job (not <deleted>)
