Thai court verdict further destabilizes government

Bangkok - Thailand's Supreme Court on Tuesday found the Deputy Leader of the People Power Party (PPP), which heads the current coalition government, guilty of fraud in the December 23, 2007 election, raising questions about the Cabinet's political longevity.

The Supreme Court for political offences found Yongyuth Tiyapairat guilty of giving money to ten village heads in Chiang Rai province to assure the election of his sister, La-ong, in the last polls.

The court banned Yongyuth from political office for five years and annulled his sister's electoral victory in the December 23 polls, in which the PPP won the majority of seats.

The court ruling has serious ramifications for the future of the PPP, which leads Thailand's current coalition government.

Under Thailand's election laws, if a party executive is found guilty of electoral fraud the whole party may be dissolved if it can be proved they colluded in the fraud.

"I am sure the party will be dissolved unless there is a miracle," said Police Lieutenant Colonel Karn Tienkeow, a Deputy Leader of the PPP. "In Thailand it is too easy to dissolve parties." *it's not easy in the slightest... discounting Samak's proclaiming it will happen by tonight*

Thailand's Election Commission will hereafter need to rule on whether to go ahead with a case to dissolve the PPP, a process which would take several months.

The PPP, composed of many politicians related or allied to the disbanded TRT, campaigned on a platform of reintroducing Thaksin's populist policies and providing him fair treatment by the judiciary.

The Supreme Court earlier Tuesday started a trial against Thaksin and his wife Potjaman in the first corruption case to be successfully lodged against the controversial billionaire politician. Neither Thaksin nor his wife appeared in court.

Yongyuth disqualified after videos prove electoral fraud

The Supreme Court's election division yesterday found former Deputy Leader of the PPP Yongyuth Tiyapairat guilty of violating election law by offering money to a group of kamnans in return for helping his sister win in the general election last year. The court ordered Yongyuth's political rights be revoked and banned him from politics for five years. The court ordered a by-election in Chiang Rai's constituency 3 to find a replacement for La-ong Tiyapairat, Yongyuth's sister. The court said there was nothing wrong with the two VCDs used as evidence to back up the electoral fraud allegations against Yongyuth. Yongyuth and La-ong did not say that the group of people in the recordings were not the kamnans from Chiang Rai's Mae Chan district. Yongyuth and La-ong had contested that one VCD was made on Oct 25 last year prior to the kamnans' journey to Bangkok and the other on Oct 28 after the meeting in Bangkok between the kamnans and Yongyuth. One VCD showed the kamnans at Chiang Rai airport, while the other showed them walking out of Suvarnabhumi airport to wait for a minivan. The court found that the two VCDs showed the same group of kamnans travelling from Chiang Rai to Bangkok on the same occasion. The court believed the footage in the VCDs featured the trip by the kamnans from Chiang Rai to Bangkok on Oct 28. The VCDs were given as evidence by Wichit Yodsuwan, Chart Thai Party's candidate in Chiang Rai, who filed the vote-buying complaint against Yongyuth with the EC.

The former House Speaker assured that he is still in Bangkok and is not distressed by the court ruling as it as an event he had anticipated.

It is not often that someone will actually go the full hog in making a complaint and not changing their testimony under pressure in cases against the very powerful and we are talking a very poweful man and family with a lot of influence in this case.

Key witness in Yongyuth case dismissed as kamnan

Kamnan Chaiwat Changkaokam, a key witness in the disqualification case against former House Speaker Yongyuth Tiyapairat, has been dismissed from duty, a source said on Monday.

Mae Chan District's Administration Division issued the dismissal order to Chaiwat as Kamnan of Tambon Chanchawa, Chiang Rai's Mae Chan District on the grounds that he has been absent from work since December last year without giving reasons.

The Supreme Court's disqualification of Yongyuth as People Power Party (PPP) party list MP after convicting him on charges of electoral frauds has threatened the very existence of the ruling coalition party. The Constitution stipulates that political parties must be held accountable for wrongdoings committed by party executives. Yongyuth was the PPP deputy leader.

Due the court ruling, the Election Commission is obliged to set up a panel to scrutinise if there are grounds to dissolve the PPP.

PPP favourite set to regain seat in North

Yellow-carded La-ong Tiyapairat, the sister of former House Speaker Yongyuth Tiyapairat, was poised to make an easy comeback in yesterday's by-election, according to unofficial results. As of 7.30pm, La-ong of the PPP had 69,561 votes in constituency 3, with Democrat candidate Kittipong Namwong trailing far behind with 19,314 votes. Ballot boxes from a few polling units located in hilly areas were still on their way to the tally room, slowed by pounding rains in the evening. Constituency 3 takes in Mae Chan, Mae Fa Luang, Mae Sai and Chiang Saen districts, with 188,109 eligible voters. La-ong was disqualified on suspicion of cheating in the Dec 23 general election. Her brother Yongyuth was red-carded for vote buying when he was a PPP executive member.

Yongyuth's Sister Wins By-Election in Chiang Rai

Yellow-carded La-ong Tiyapairat, sister of former House Speaker Yongyuth Tiyapairat , won the by-election in constituency three of Chiang Rai province.

A new round of voting in the third constituency of Chiang Rai province was held yesterday, after the Supreme Court division for election cases confirmed a yellow card for People Power MP La-ong Tiyapairat and a red card for her elder brother Yongyuth on the recommendation of the Election Commission.

La-ong got a decisive victory with 170,184 votes, while the second place Democrat MP Kitipong Namwong got only 19,480 votes.

However, the election results have to be approved by the Election Commission as soon as it is confirmed that no electoral frauds have been reported.

The third constituency covers the areas of Mae Chan, Mae Fa Luang, Mae Sai and Chiang Saen districts in Chiang Rai province.

Why I veered MPs away from Samak : Yongyuth

At a party on Wednesday night, former People Power Party Deputy Leader Yongyuth Tiyapairat explained why he had manoeuvred his faction against voting former PM Samak Sundaravej back into power.

Speaking at a dinner he hosted to celebrate the ministerial appointments of MPs under his wing, Yongyuth said what he did on September 11 was not a means to strengthen his power base, but to bring conciliation to the country.

"We cannot afford confrontations. I could see that the country would not move ahead. If we as a government commit wrongs, we will die and reach our end,'' he declared at a restaurant in Nonthaburi. * Anything about how "If I commit wrongs, I will die and reach my end" ??? *

Yongyuth's faction was rewarded with several ministerial posts after he helped dilute the Friends of Newin (Chidchob) who were pushing either Samak or Surapong Suebwonglee for the PM's post.

Members of Yongyuth's bloc who were given portfolios include Deputy Prime Minister and Foreign Minister Sompong Amornwiwat; Education Minister Srimuang Chareonsiri; Culture Minister Worawat Ua-apinyakul; Deputy Interior Minister Preecha Rengsomboonsuk; Deputy Commerce Minister Songkram Kijlertpairote; Deputy Transport Minister Sophon Salum, and Deputy Agriculture Minister Theerachai Saenkaew.

Members from the Newin faction lost their portfolios, including Songsak Thongsri, because they had reportedly upset PM Somchai Wongsawat for lobbying other PPP MPs to vote for either Surapong or Samak and saying that if they voted for Somchai the government would be toppled in a military coup. Their reasoning was that if neither Samak nor Surapong were voted in, former PM Thaksin Shinawatra would never be able to return to the country and that the party would not have much of a future.

That is when Somchai's Chang Song La faction used Yongyuth's league to break up Newin's group and cut down its bargaining power. Yongyuth, who controls MPs in several provinces in the North and Northeast, instructed members of his group to lure MPs away from Newin.

The Friends of Newin, which was previously comprised of 72 MPs, has now been reduced to just 20 with close to no bargaining power.

The National Counter Corruption Commission yesterday found cause to suspect Yongyuth Tiyapairat guilty of concealing shares in his financial statement to the NCCC when he was Environment and Natural Resources Minister.

The NCCC said an investigation found that Yongyuth had not sold 24,500 shares in the Niti Foods Products to his brother-in-law for 2.45 Million Baht and had not lent 1.6 Million Baht to the same person, as declared in his financial statement.

The NCCC decided to indict Yongyuth in the Supreme Court's Criminal Division for Holders of Political Office. If the court finds Yongyuth guilty, he would be banned from politics for five years. This would be on top of his five-year ban due to electoral fraud.

Yongyuth to stand trail for filing false asset statement

The Supreme Court on Thursday ruled to launch the judicial review on banned party executive Yongyuth Tiyapairat for filing a false asset statement when he was the Natural Resources and Environment minister in 2005.

Presiding judge Sirichai Chiraboonsri has set the first inquiry session to examine defence evidence on April 16.

On behalf of the nine-judge panel, Sirichai has also instructed the Chiang Rai Provincial Court, with jurisdiction over the defendant's domicile, to notify Yongyuth to submit his defence within seven days.

As plaintiff, the National Counter Corruption Commission contends that Yongyuth falsified his shares transaction in order to cover up his wealth.

In his asset statement, Yongyuth declared his sale of Miti Food Co shares worth 2.45 million baht to his brother-in-law, Police Lieutenant-Colonel Natthawut Yuwawan.

He claimed to have received from Natthawut a down payment worth 850,000 baht.

Based on the plaintiff argument, the transaction could not be verified because the company was a front with no business activities for 18 years and Natthawut was not in the financial position to handle such transaction.

The NACC found Sombut’s asset declaration did not include nine bank accounts holding more than 100 million baht in his wife's name. The hearing into Sombut’s case will be also held on April 16th.

Yongyuth and Sombat served in the Thaksin government in 2005.

In the case against Yongyuth, presiding Judge Sirichai Chiraboonsri, on behalf of the nine-judge panel, instructed the Chiang Rai Provincial Court, with jurisdiction over the defendant's domicile, to notify Yongyuth to submit his defence within seven days.

As plaintiff, the NACC contends that Yongyuth falsified a share transaction in order to cover up his wealth.

In the case against Sombat, he was accused by the NACC of failing to report money his wife held in a joint bank account with their son.

Sombat had omitted the bank accounts, which were later found to hold money ranging from 86.2 million to 111.5 million baht, in nine financial reports he submitted to the NACC.

It seems he could do anything he liked with no respect for the law whatsoever. The Assets case is just a time waster, even if found guilty very doubtful he will get jail time, Do anyone know if and when he is due in court on the shooting case with the old couple??.

Yongyuth jailed for 2 months and banned 5 years

The Supreme Court on Monday found former House Speaker Yongyuth Tiyapairat guilty of concealing his Bt2-million assets and sentenced him to two months in jail as well as banned him from politics for five years.

The National Counter Corruption Commission had accused Yongyuth, also a former natural resources and enviroment minister for submitting false declaration of his assets after leaving his ministerial post.

The Supreme Court's Criminal Division for Holders of Political Office however suspended his jail term. Yongyuth was also fined Bt4,000.

Yongyuth appeared at the court and seemed to show no feeling after hearing the verdict.

Last week the court on Friday ruled against former deputy interior minister Sombat Uthaisang for concealing his wife's assets of Bt106 million.

Although the court suspended the jail term for a year, Sombat was also banned from holding any political position for five years.

Sombat, who was also an adviser to the information and communications technology minister in a Thaksin Shinawatra government, did not declare nine bank accounts his wife was sharing with their three mature children.

Besides a Bt4,000 fine, the court also gave Sombat a two-month jail term for falsifying the assets-declaration statement given to the National Anti-Corruption Commission after he took office .

Although the court suspended the jail term for a year, Sombat was also banned from holding any political position for five years.

The court also earlier disqualified a Nakhon Sawan senator, Orapin Munsilp, over similar charges. It is scheduled to give a verdict on the assets-concealing case against former natural resources and environment minister Yongyuth Tiyapairat on Monday.

The pictures below seem to indicate that Thaksin has also had his ass*** probed.

Former PM Thaksin Shinawatra tees off in Dubai Friday. He posted this picture on his Twitter page Saturday to show he did not have prostate gland cancer.

But he's just in the last few days told his supporters that he's run out of money!

- So I guess his friends in the picture are paying his green fees for him. Or..

- Perhaps his green fees were paid from the funds sent to him from the Isan rural poor.

- Or perhaps he found some loose change after buying another diamond mine, or buying another personal aircraft. Or perhaps even loose change after buying another passport from a never heard of country.

What a scumbag.
