Hi all,

I just have a few questions for anyone in a helpful mood.

I want to apply for a non-Imm B visa in Vietianne. A friend of mine (who has previously done these for others) has said all you need is a letter (on a proper letterhead) from a company stating your details, salary and job title.

The last non-Imm i got was in Singapore some 4 months ago- i needed lots of documents like company registration, bank details, etc.

Would anyone mid telling me if the embassy (or consulate as it might be) in Laos accepts applications with just a letter? I need to do the visa thing next week (before the 6th) and despite working for a company they cannot provide a non-Imm b visa again and so I was going to get a letter from a business in my home country who does business in Thailand.

I would appreciate any useful words.

Do you have a work permit. Just getting a B visa does not make it legal to work.

You say that the company cannot provide the documents again. That seems to a little unusual.

At a minimum you will need a letter from a company here. A letter from a company outside Thailand would not work.

You might want to consider getting a 2 entry tourist visa that would give you a total of 6 months by getting a 30 day extension and then making a border run after 90 days. And then getting another 30 day extension.

thanks for the reply. I was considering the 2 entry tourist visa from Laos. However I would prefer the multiple entry non-Imm B from Vientianne (as it is longer and a work permit can be done from there). I know it is illegal to work without a work permit and that the non-imm is NOT a work visa.

Without going into specifics about the company, basically it was a short project that has turned into ongoing work, but again it is not certain. The boss will provide a letter. My question was really just whether or not JUST the letter from the employer is sufficient to obtain the non imm B via, or, if I need extra documents as well.

You will not get a multiple entry visa from any nearby consulate without a work permit. You can try for a single with a letter and/or other documents. If that fails get a tourist visa.

The documentation you need for non immigrant B visa.

With this you'll probably get a single entry visa. (with WP3)

After you get your WP you can apply for extension of stay (if qualify) or go outside Thailand for a multiple non-B for one year.

2. Application for Visa

2.1 Non-Immigrant Visa Category “B” (Business Visa) is issued to applicants who wish to enter the Kingdom to work or to conduct business.

(1) Foreigners who wish to work in Thailand must provide the following documents:

- Passport or travel document with validity of not less than 6 months.

- Completed visa application form.

- Recent passport-sized photograph (4 x 6 cm) of the applicant taken within the past 6 months.

- Evidence of adequate finance (20,000 Baht per person and 40,000 Baht per family).

- Letter of approval from the Ministry of Labour. To obtain this letter, the applicant’s prospective employer in Thailand is required to submit Form WP3 at the Office of Foreign Workers Administration, Department of Employment, Ministry of Labour Tel. 02-2452745, or at the Provincial Employment Office in his or her respective province. More information is available at www.doe.go.th/workpermit/index.html

- Copy of Work Permit issued by the Ministry of Labour and alien income tax or Por Ngor Dor 91 (only in the case where applicant has previously worked in Thailand).

- Corporate documents of hiring company in Thailand such as:

1) business registration and business license

2) list of shareholders

3) company profile

4) details of business operation

5) list of foreign workers stating names, nationalities and positions

6) map indicating location of the company

7) balance sheet, statement of Income Tax and Business Tax (Por Ngor Dor 50 and Por Ngor Dor 30 of the latest year)

8) value-added tax registration (Por Por 20)

- Document indicating the number of foreign tourists (for tourism business only), or document indicating export transactions issued by banks (for export business only).

N.B.

- An alien who receives a Non-Immigrant visa can work in Thailand once he or she is being granted a work permit. An alien in violation of the Immigration Act B.E. 2522 (1979) concerning taking up employment without work permit or the Royal Decree B.E. 2522 (1979) concerning holding employment in certain restricted occupations and professions shall be prosecuted and imprisoned or fined, or shall face both penalties.

- It is recommended that the applicant should apply for visa at the Thai Embassy/ Consulate in the country where he/she has the residence

From what I have seen on this forum, since a few months ago also Vientiane now wants the receipt for the work permit application in addition to the usual company documents, and all they will give is a single-entry non-B, no multiple.

If it's your first time to apply for a non-B, how can you have a work permit beforehand? And how could you apply and receive a recipit, when the Dept of Labour wants to see the extension of stay from immigration first?

Application for a work permit can be made when the applicant is in Thailand on any type of permission to stay, which can be after entering without a visa, with a tourist visa or a non-immigrant visa, or after getting any type of extension of stay. Then, with the receipt for the application for the work permit, get a single-entry non-B visa. Next, pick up the work permit after it is processed, then apply at the immigration office for the extension of stay for employment if the necessary requirements can be met.

At least that's how I believe the current procedure to be.

Correct - Labour can accept a Work Permit application 'visa pending'; you can then make a visa run to apply a non immigrant B visa.

Normally, copies of the new non B visa and it's new associated 90 day Permission to Stay stamp should then be produced at labour within 7 working days.
