My Thai wife is applying for a US immigrant visa. She's already scheduled for her interview but we've received conflicting information from the embassy about which affidavit of support to use. They gave us I-864 with the application form but later on gave us a notice with the instructions to use I-134. As is so often the case policies and procedures change but paperwork isn't updated. I prefer I-134 because it's shorter and easier but I don't want to set back the whole process because I used the wrong form.

If you are applying for a K-3 visa, you use the I-134. If you are applying for an IR1, you must file an I-864. The K-3 is a non-immigrant visa that has some of the requirements of the immigrant visa. If you take her to the States on an I-134, you must apply to adjust her status to a permanent resident and eventually file an I-864 anyway.

Thanks, Johnny Dee Rock

I'm applying for the IR1 but I guess they gave me the wrong information for that visa.

In fact I'll have to apply for adjustment of status anyway because we've been married for less than two years, according to the information we were given. My question is: Is that info also for the k-3 or does it apply to the IR1 as well?
