Hi all,

My thai husband is in the UK on a Fiance Visa and now we have married we are preparing to apply for FLR. I was hoping to book an in-person appointment for beginning of Sept but I am slightly confused about the new English Language requirements I have read about on the UKBA website.

My question is will he have to meet this new requirements when he applies for his FLR or does this not apply to him as he has already been given entry clearance to the UK before the new legislation came into power or is it yet to come into play?

The new requirement will effect those applying for settlement as a spouse, fiance etc. outside the UK. It does not apply to him as he is already in the UK.

Remember, though, that he will need to satisfy the existing knowledge of life and language in the UK requirement in order to apply for Indefinite Leave to Remain in 2 years time.

So let me understand this correctly, as the OP, we entered on a settlement visa ( marriage ) valid for 6 months, we get married in 10 days, then i have a premium booking in croydon on the 20th of Sept for extension...

so as the OP, i assume that the language requirement do not apply to us as we are already here in the UK?

Yes, the new requirement will only apply to those making their initial settlement application; either from outside the UK (or those who are already in the UK, e.g. as a student. Thanks, Sumrit, for that update.)

If one already has their initial settlement visa then this new requirement will not apply; although, as said, the KOL requirement for ILR will.

That is my understanding, anyway.
