Hello,

as requested I have returned my work permit to my employer due to termination of job contract. I was told they will cancel the work permit at Labour department and provide me with the receipt which I have to show to immigration.

Question: is there a time frame within an employer must terminate the work permit @ Labour and give that receipt to me? I am very afraid I am running in trouble with the Immigration.

After you resign from your work, you must return the work permit within 7 days from the date of the resignation.

PENALTY : Anyone who violates this rule will be fined 1000 baht.

An employer who employs you to work and allows you to resign must notify the Employment Service Office within 15 days from the termination date.

PENALTY : Anyone who violate this rule will be fined 1,000 baht.

Thanks a lot for your answer. I returned my work permit on Oct. 4th, Employment was terminated Sept. 26th. (by word). What does it mean in my case? How do I handle the immigration because I do not have received any paperwork from my previous employer yet. Your further advise is appreciated.

You need the Tor Tor 10 form from the Labor Dept.

If you had an extension of stay permit based on business, then you have 7 days after the notification to leave the country. In this case after the 7 days , you will be considered overstay and every day you over stay in Thailand will be a fine of 200 baht.

If you had a non immigrant visa with NO extension of stay permit, then you are able to leave Thailand when your visa expires.

Sunbelt gave the rules but to avoid any chance of error I would say "you are able to stay until your current permitted to stay stamp date" if not on an extension of stay for work you lost rather than "you are able to leave Thailand when your visa expires". Small point but visa expiration is the date on visa itself and is often misunderstood.
