Retirement Dependency Visa Question.

My friend just obtained a retirement visa in Thailand. Her husband, who is currently on a O-A retirement visa which was obtained in the UK expires in October. We have heard that her husband will not be able to obtain a dependency visa due to the fact he is over 50 years old and should get his own retirement visa in Thailand, but then that means bringing over more money to Thailand, which they would like to avoid. We would like to know if this is true or not or if he would have no problem getting a dependency visa despite his age. Are there any other factors that we are missing?

Being over age 50 means nothing for dependent extension - he should not have any problem obtaining if wife has one year extension of stay for retirement. But believe marriage paperwork must be certified by Embassy/translated/registered with MFA and recorded at a District Office in such cases.

2.20 In the case of a family

member of an alien who has been permitted temporary

stay under clauses 2.1, 2.2, 2.3, 2.5, 2.6,2.7, 2.10, 2.12, 2.13,2.4, 2.15, 2.16, 2.17,

2.21, 2.22,2.26,6.29 of this Order (applicable only to parents, spouse, child, adopted child or child of

his/her spouse):

granted for a period of

not more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM);

(2) Proof of family relationship;

(3) In the case of a spouse, the marital relationship shall be de

jure (legitimate) and de facto;

If he has an O/A visa, is a multiple entry visa? When was it issued, and what date does it expire? If it a multiple entry, if he leaves and re-enters Thailand the day before it expires, he will get another 1 year permission to stay and will not have to move funds to Thailand.

I'm not sure if dependent visa extensions are granted when the husband visa is issues outside Thailand.

I believe that the husband has to be on a visa extension issued in Thailand for the depended visa to be given to the wife.

Please correct me if i'm wrong.

She has a retirement extension inside Thailand from the OP. He may get some grins (as dependent husband) but should be able to obtain.

If he has an O/A visa that expires in October 1012 and it is multiple entry, can't he do a border run the day before it expires and get another year. He would not have to transfer any funds to Thailand. If he only has a single entry, then so be it!

He is already on his 2nd year therefore it finishes in Oct 2012. Also his wife already has an retirement visa issued in Thailand and he wants to go on as a dependent so he doesn't have to bring more money into Thailand. Thankyou for all of the responses. It seems like he will have no problem getting it. :)
