So you're comparing driving without road tax to driving under the influence? Wrong comparison, it is a minor offense, just like forgetting to signal.

No just saying driving without tax is illegal.

In the UK a friend of mine smashed his car into railings when drunk, ran from the scene and the insurance company paid out.

Would make a great promotional ad for Tanachart insurance company, don't you think?

Yes, as is turning without signalling, etc., to which you said "By illegal I was thinking more in terms of driving without road tax (the o/p subject), driving without a driving license or driving under the influence of drugs or alcohol."

Even drunk it would make no difference. They sell you insurance and as long as you meet the requirements outlined in the policy they pretty much have to pay.

Virtually every time there is an accident someone has broken the law, yet the insurance most always pays. They would not pay if they didn’t have to. They make their money collecting premiums, not paying claims. They may fight it, or try to low-ball you, but ultimately they have to pay.

So if you had fire insurance on you home, and you had failed to pay your property tax when your home burned down, could the insurance refuse to pay? I think not.

If they issue the policy to you, they have to provide coverage until they cancel.

Agree with you, but:

in quite a few countries worldwide if you have been driving drunk, the insurance 3rd party will pay out, but not for own damages. And they might even try to recoup the made 3rd party payments.

But that has nothing to do with expired road tax, and is only possible if the policy indicates such.

Until this year I've had no issues renewing my car tax via the local guy's inspection place - but this time he's demanded a full respray at a cost of 40,000 baht. My car is a 20 year old Toyota Vitara, is fully insured and is in good mechanical condition as well as only having a paint issue on its roof where the sun has got at the paintwork- also a few very minor scratches on the body.  I'm really nervous about continuing to drive with an outdated tax disc - and also have no other way to get essential shopping and other needs downtown as I live in a small village off highway 118.

 

When I took the car to his place for inspection as usual- I was horrified at his refusal - as it was the first time in 15 years I've had an issue. Any advice would help.....
