If polling nullified, EC should pay for the cost: Thai govt

It is the EC function to hold an election within the time allowed by the constitution, every other EC was able to fulfill its job requirements, the EC failed to post Army or police to insure voting could take place uninterrupted and closed some polling place to insure a protest could be filed against the election.

It is the EC function to implement the laws that govern the election, not re-writing those laws, they should be responsible for the cost of the election for failing to properly preform their required duties!

Cheers

Why don't you just take off your RED tinted glasses, they did their job which was to hold the election, not to organise security, yingluk was warned it would be disrupted but as usual took no notice. coffee1.gif

Thai PM maintains February 2 election date: ruling party source

BANGKOK (Reuters) - Thailand's prime minister has confirmed a general election will be held on February 2, a source from her party said on Tuesday after a meeting at which the election authority had proposed a delay because of unrest in the capital.

" Surapong said he would file petitions with the Office of the Auditor-General and the Comptroller General's Department to check if the EC spent the funds in a transparent manner. "

Perhaps Surapong could order transparency checks on how monies have been delegated over the last two and a half years by the former Yingluck administration.

" He urged the EC to announce the results of the election in areas that had no protests or obstructions. He said the EC might risk legal action for dereliction of duty if it failed to announce the winners of the MP seats. "

The EC can't do that. They can't announce any winners until all the results are in. The EC would risk legal action if they did announce any winners. It's time for Thaksin's cousin - who is now a private citizen according to Article 127 - to muse on how dreadful he's been in an administrative capacity.

How can they judge whether or not 95% of the seats have been filled, if they don't announce the results?

If it isn't the EC responsibility to police the elections, who's is it? Thus ANYONE who prevents the election from happening should be in breach of the law, if it is the case that the EC has a legal obligation to carry them out. Thus EVERYONE who was part of preventing the EC from carrying out the election should be charged accordingly. Thus, if the EC must bear the cost of not carrying out the election, but it is prevented from doing so by protesters, and the EC have to foot the bill, thus, the EC must sue those responsible for preventing it from carrying out the election for damages.

How many billion was it?

Of course, when you don't actually arrest people and charge them for their legal wrong doing you end up in chaos where everyone points fingers at everyone else and says "they did it".

1) the EC is not allowed to announce the results until the election is completed.

2) the police is responsible for the internal security. The EC is just an admin function, they don't have any law enforcement function.

Seems to me that government has now put on record that the persons responsible for the wasted money on the elections should pay, seeing as they failed to listen to the advice of the EC then it should be the Shinawatra's and the PTP digging in to their own pockets.

P.S. dos that 3.2Billion include cash incentives for votes paid out by the PTP?

I'd like to see the EC now sue the individual MP's (not the government) that pushed for this election date and ignored the EC's advise to change the date - the police and government could also be sued for failing to provide security at polling stations

Enough of this nonsense from PTP as they try to direct blame everywhere else but themselves
