On the VFS web site for a visa for Spain it says that the applicant must have 3 months remaining on there UK settlement visa it this really enforced? as it seems a bit unfair when traveling with a EU citizen.

If you apply at the Spanish embassy instead do they enforce this rule also? as past experience with the VFS center they asked for documents that where not required.

I don't quite understand, what is your plan? Are you planning to travel to both Spain (Schengen area) and the UK? What is your nationality? What is your maritial status?

If you are a EU citizen (any except a Spaniard) and traveling to Spain with your Thai spous then the Spanish embassy would have to issue a visa quickly, free of charge and with mimimum hassle. You should only be required to show your family relationship by marriage (the marriage certificate plus legalisation by Thai authorities SHOULD be sufficient but the Spaniards seem to request some sort of confirmation from the EU citizen's home country aswell, which is total <deleted> since all you need to prove is that you are actually married, no need to have your marriage registrated in both EU and TH...) and showing that you two will be traveling together or joining eachother in Spain (a written statement plus pasport copy from the EU spouse should sufficient, a ticketreservation might also help but it shouldn't be mandatory).

If you are just unmarried partners, the general Schengen visa requirements apply (proof of support, guarantee, return etc. etc.).

Also see the Schengen Visa FAQ pinned at the top. I'm guessing you and you'r Thai partner (spous??) are living in the UK and you're applying from there? The status of your partners right of entry to the UK is irrelevant, this just considers a trip to Spain and aslong as you leave the Schengen area in time there is nothing for them to worry about... If the Thai leaves for TH, UK or hops in a boat to visit antartica...

Also, I'd consult the Spaniards directly, you are entitled to this and saves you the trouble of dealing with less comptent VFS staff plus that silly service fee...
