Section 3. Children under 18

Is this section only for children under 18 that are living in the uk and who are applying with the applicant?

My wife has a son who lives in Thailand with his farther. Should his details be put in 3.6 ?

I do see a question later about ties with country you lived in for more than 5 years.

Any ideas guys?

It can be confusing, as the opening paragraph of section 3 says

You are required to provide details of any children under 18 who are living with you in the UK, and who are applying for indefinite leave to remain as your dependants.

My initial reaction would be to ignore the son as he does not live in the UK and is not applying for ILR with his mother.

But Q3.2. asks if the applicant has any children whose parent is not their partner. Does this mean children living with the applicant in the UK and applying at the same time (as was the case with my wife and step daughter)? Or does it mean any children, period?

I don't know.

So, to be safe, I would answer 'Yes' to 3.3, then 'No' to 3.4 as the child doesn't live in the UK and then put his details in 3.6, expanding upon this in 3.9 if you feel it necessary.

but it does ask the question ' how long has this child resided in the uk'?

Which leads me to think its not the correct section to include the son.

Some of the questions are still relevant as u pointed out.

Think I will enter the child's details in the extra info section at the end of section 3 and add that he's not living in the uk nor applying for ILR.

I'd put "He does not live in the UK."

If you use the Settlement Checking Service, they will, for a fee,

  • check you have completed your SET(M) form correctly
  • check you have paid the correct application fee
  • copy and return your valuable documents
  • ensure your application is valid and post it to UK Visas and Immigration

We have an appointment( PEO) tomorrow at Croydon.

Thats the only section thats bugging me.

As the title is ' Children under 18' so would make sense to answser the questions appropriately.

does that mean also?

As u said its a bit unclear.

Maybe the best solution is to leave that section blank and then ask at the PEO when you get there?

I/we filled in the section 3 and then added that the child was not applying for ILR .

No questions from PEO, everything done and dusted within 2 hours start to finish, ILR granted!

Similar to wylos's situation, despite what the opening paragraph says, Q3.1 asks if the applicant has any children with their partner.

I think that this is there because the partner may not necessarily be a British citizen or, if not, have ILR themselves.

I would answer Yes to this and put the child's details in 3.6 then in 3.9 say that the child is a British citizen and so not applying for ILR.
