If you use the checking service when applying for ILR, I believe that they give you your passport back are there any problems with using the passport when your application is still being decided?

The applicant can continue to use their passport, Maprang.

Just ensure that the applicant has a current valid visa when returning to the UK to avoid any hold ups.

No problems at all but hopefully it will be flagged up on the Immigration Officers system that ILR has been applied for, coming back through the airport. Generally all this means is a question or two about the length of your time outside the country.

Might be worth carrying some confirmation that ILR has been applied for just in case as the dates on the visa may well show it has expired! Legally the visa is still valid while the application is being processed!
