davos09 Posted July 8, 2014 Posted July 8, 2014 Hi guys, Been a long time since I've asked for advice here, but wondered if someone could give me some clarity on the following: My wife has a 27 month settlement visa as my spouse - we managed to apply a day or two before the 5 year qualifying period visa came into effect back in July 2012. The valid from date on her visa is 29/09/12, valid until 29/12/14. She entered the UK on 08/12/12 (still within the extra 90 day period) and has been here ever since with no absence from the UK. I've been reading up on ILR this morning and my understanding of it now is that she could apply on 01/09/14, as it would be 28 days before the visa started 2 years ago? I always assumed it would be 28 days before the date of entry to the UK - which would be 10/11/14? So the real question is when should she apply? And if she was able to apply 01/09/2014, do we have to apply then, or can we apply anytime after that, but not beyond 10/11/14? Look forward to hearing from you
MaprangHolmes Posted July 8, 2014 Posted July 8, 2014 It would be from the time of entry so the 08/12 less the 28 day period. You can apply anytime up to when the visa expires so up to the 29/12 1
