Popular Post Lite Beer Posted August 8, 2014 Popular Post Share Posted August 8, 2014 Supreme Court rejects Sondhi’s bail request BANGKOK: -- The Supreme Court has turned down the request for bail of Manager Group founder Sondhi Limthongkul and his associates who are facing a 20-year jailterm for falsifying information of an affiliated company in violation of the Securities Act. The Supreme Court said there was no justification to grant them a bail because they had not yet appealed the Appeals Court’s verdict to the Supreme Court and had not asked for endorsement of their appeal. Earlier, the Criminal Court refused to consider their request for bail and submitted the case to the Supreme Court for consideration. Sondhi and his associates are currently held in prison pending trial by the Supreme Court. He has done a lot of damage to the country and I wouldn't feel sorry for him if the spent the rest of his life in prison. Now, time for a few dozen more to also be imprisoned for life. Based on the article it sounds like it could end up in the Supreme Court again as the reason for their denial was jurisdiction since they had first not appealed to the appeals court. Assuming they now need to go back and do that and then if denied bring it back to the Supreme court assuming they can meet any possible deadlines for filing. Kind of surprised a man of his means would have such an incompetent lawyer ... actually I don't believe it and believe something else is up we don't know. The supreme court, probably in every country which has one, only hears cases after they have been exhausted elsewhere. There have many other blatant thefts from KTB by prominent persons, mainly politicians who borrowed against worthless collateral, but Sondhi is one of the few culprits who have ever been brought to justice. Hopefully this case will allow it to function more as a real bank and less of a politicians' piggy bank. His lawyer submitted a Bt10-million bail application as he plans to appeal to the Supreme Court. The Supreme Court turned down the release request Friday because it believed Sondhi might attempt to flee the country. The Appeals Court on Thursday upheld the primary court’s verdict. Sondhi was accused of falsifying documents that were used as collateral for a Bt1-billion loan for his media empire, the Manager Media Group. In its verdict, the court stated that Sondhi and three other Manager Media Group board members falsified a loan guarantee document from 1996 to 1998 to get the Krungthai Bank loan for a private company in which Sondhi was the majority shareholder. It said the other board members were not aware of the fraud and did not give their approval. The court also ruled that Sondhi and the three board members committed accounting fraud by not including the company’s status as the loan guarantor in its financial report, which misled investors. It may be a coincidence that the SEC, which initiated the case is petitioning the NCPO for legislation to allow it prosecute fraud cases by itself. This is a very rare case that even got to court. Most of the SEC's fraud cases involving prominent persons have been quashed by the police or the attorney general for obvious reasons. This is an example of what the SEC could do if it had its own power of prosecution like the NACC. Otherwise it is largely toothless. AMLO is also pushing for the same powers. Another important reform would be to make the SEC (and AMLO) independent of the finance ministry and justice ministry respectively and make them more like independent agencies. The level of fraud in the market involving inside trading and lack of disclosure of reportable trades concealed thro offshore nominees is staggering. Time to level the playing field a bit. The sentences are to be served consecutively as opposed to concurrently which happens in other parts of the world. Thai law limits the total custodial sentence to 20 years, so Sondhi is effectively sentenced to 20 years which given his age is a life sentence. This supreme court decision is about bail. Sondhi's legal team will now take the appeal against the appeal court's decision (and the original conviction) to the supreme court. Yes but if you read the other topics about this you will see that Yellow shirt / anti government protesters are applauding this instead of saying its political like the red shirts do about Taksin and YL. I am really really happy they went after him and got him (still have to see if they will get him) I have seen other known yellow posters also applauding it. Total difference from the like of Fab4 and others who look at any excuse for their side. If Suthep is next for something.. count me to those who applaud then to. This guy who did not physically harm anyone can't get bail and gets 20 years in jail, but convicted murderers can get bail so they can go out again and kill. Doctor's who cut up their ex-wives only go to jail for 10 years, but a husband and wife who look for food in a National Park go to jail for many years. Its a win win for them, lock up this blabber mouth and appear to be impartial, whereas really they wanted to get rid of him anyway.
