Regulator to appeal court decision allowing PeaceTV back on air

BANGKOK: -- THE National Broadcasting and Telecommunications Commission's Broadcasting Committee will appeal the Central Administrative Court's decision to issue a temporary injunction allowing Peace TV back on air.

The vote yesterday to appeal Thursday's decision was three to one.

Supinya Klangnarong, a member of the Broadcasting Committee, revealed the decision on Twitter but said she was absent from the vote.

Another commissioner, Thawatchai Jittrapanun, missed the meeting because he was on duty in Chiang Mai.

The commissioners who voted to appeal the decision were Colonel Natee Sukonrat, the panel chairman, Pol Colonel Thaweesak Ngamsagna and Lt-General Peerapong Manakit.

On April 30, the broadcasting regulator decided by a majority vote to revoke the licence of the politics-oriented satellite-TV station for breaching an agreement with the regulator, as well as orders issued by the junta.

After the Central Administrative Court's decision on Thursday, Peace TV executives said the station would be back on air on Monday. The channel has been broadcasting via Youtube since its licence was revoked.

But red-shirt leader Jatuporn Prompan's programme, "Mong Klai", would remained suspended because it sparked the dispute that led to the licence being cancelled.

Led by the station's legal representative, Thanadet Puangpoon, Peace TV filed a lawsuit against the broadcasting regulator at the court last month, claiming its decision to revoke the licence was unfair.

The operator demanded Bt15 million in compensation from the watchdog, and claimed it had suffered Bt7.5 million a month in damages since it was forced to shut down.

It's not a conflict of interest when you're a Foreign Minister in your Cousin's government and open your ministry especially to produce a new passport which you then personally hand deliver to a convicted criminal fugitive who is also your cousin and happens to be the elder brother and "mentor (haha)" of the cousin who is PM. Even though it appears illegal to issue a passport to a convicted criminal, somewhat immoral to hand deliver it to a on the run fugitive personally, and an abuse of power to open a ministry to do it; it wasn't considered a conflict of interest by some.

Hear we have a panel deciding to appeal a court decision, how radical of them.

The commission (of the NBTC) of 5 consists of at least 3 army and police folks.
