hi,

looking for helpful advice,

my gf and i have been together for nearly 3 years. She is an air stewardess and earns a good salary, and is also a property owner of a house valued around 3million baht. Cos of her job she has a 5 year working visa for USA and 10 year tourist visa, but not for the UK.

She has been here 3 times already on 6 month tourist visas to visit me and has always returned with no problem. She also has a good education from private university.

What we are looking to do is for her to get a 2 year visa so that she can come and work here and then study here also for a masters degree. The only problem is that we cant apply direct for a student visa cos the tuition fees are about £10,000 and she has 2 show that she can afford it, aswell as living costs. She is currently paying a mortgage and we dont have that kind of money.

We are hoping to outsmart the embassy a lil bit so that she can come here and work here, and help me saving for the masters degree. I am only 22 and she is 24. Does anyone know the chances of her getting a 2 year visa?

We plan 2 marry here by the end of the 2 years also, so would a fiancee visa be better? I am a recent graduate who has a job, but not yet what i would call a career job, but i should have that by the time we apply for the visa. I live at home with my parents, but they are fine with us both living here for the 2 years.

is there anyway she can work here part time just 2 help her with the masters degree, cos she wont have a student visa?

We are prepared 2 risk her working part time on a fiancee visa or student visa, cos she will apply for the masters degree after being here a year anyway.

What is the best thing 2 do?

Hi,

I'm not an expert but will just offer my advice.

My first advice would be not to try and out-smart the embassy. They deal with applications day-in, day-out and it is their business and job to find out the truth in each application. You sound like you have a good long-term relationship, and it sounds like you have done well with past visa applications which will help.

As for the point about the fiance visa, you have to get married in the following 6 months from getting the visa, and at the end of that stage, she will have to leave the country, so I wouldn't have thought that is the right choice for you. Also you are not allowed to work under a fiance visa.

With a student visa I believe you are allowed to work 20 hours a week. However I think you need an offer from a university as part of your application, but if she does not want to study at this stage yet (which is fair enough) then that also is probably not the right option for you.

The problem with coming to England to study is that it is so expensive. If she was applying for a student visa, either her or her sponsor would have to show they can afford to pay for the costs of her education. On top of this, a job that she gets whilst in england cannot be included as part of the money that will pay for the course.

As you probably already know, she cannot work with a visitor visa or a tourist visa.

Its a tough one, and its going to take someone with a better knowledge than me to help you out. But I thought I'd just tell you what I know about the subject first.

Good luck with whatever you decide. But if you do listen to any of my advice, it would be to be honest with the embassy.

If you have been living together for at least 2 years, then she may be able to qualify for an Unmarried (i.e. opposite sex) and same-sex partners visa. As an unmarried partner, she may also work in the UK. At the end of two years, she may apply for her Indefinite Leave to Remain (ILR) using the SET(M) form. One year after that, after having been ordinarily resident in the UK for 3 years, she should qualify for home fees.

Just to add what Vinny has said, if your girlfriend has a degree and has 3 years' experience in graduate level employment, she might be able to amass enough points to qualify for entry to the UK under the Highly Skilled Migrant Programme. This would entitle her to find employment in the UK.
