Lek is the Thai wife of my friend

My daughter was hit whilst being a passenger on a moped

The driver was insured but only with a blanket payout of £10,000

Insurance have paid around £7500 for hospital fees and still owe £2500 which we are still waiting for them to pay us, insurance company are called DELETED

Police said they are taking the driver on for criminal charges

Because the lawyer has asked for 60,000 bhat which I'm presuming is to take the case on ( just guessing it's for the full case to court) and they wanted another 10,000bhat for accomadation and flights from Phuket to Bangkok

My friend text me today to say that he has given my mobile phone number to the lawyer who's dealing with the case, so he can ring me

I'm not paying anything out, sounds a bit dodgy

The police will forward the case to the prosecutor. If the prosecutor considers there to be a reasonable chance of a win, then they will take the case to court.

In that case, you do not have to pay anything. It is the state vs the driver.

Your 'friend' is doing you no favors here. You are being asked for money for something that is normally free and your friend is telling you the police have threatened to put his wife in jail.

It's Bullsh*t. The money they are asking you for is just the start. It'll grow & grow and the more you send, the more they will ask for.

Lek ain't going to jail. She's in on it.

I have the same feeling. It sounds more and more like your friend is doing some strange things here, either on his own accord or on advice by Lek.

You know what you need to do.

You need to stop taking "legal" advice from your friend and his wife and from everyone on here. No one on this forum giving you their thoughts are qualified.

To ask for legal advice on this forum the way you are doing it is the most ridiculous thing you could do if you plan on acting on it. Would you approach a complete stranger on the street who wouldn't even tell you his real name and take his advice?

You need to personally contact a lawyer to handle the matter from here on.

Secondly, there should be no fees/fines involved as long as nothing has been decided yet.,

Thirdly, in accordance to typical accident situation, based off my own personal experience, your daughter should only seek her claim through the other party Insurance firm only. Not by going through the police. If the payout is insufficient to cover your expenses, you are legally allowed to pursue civil action against the other party at your own cost.

Just something else I remembered, when my daughter done the statement with the police Officer ( who had three stars on his shoulder I think a leutenant) he asked my daughter about compensation so he looked at all the hospital bills and loss of earnings and he put down 1.6million bhat, so I'm not sure if the police don't get involved in compensation why put a figure down?

Remember I said before my friend has connections with the colonel from his local station who spoke to the colonel at the one we were in, I thought the police were doing us a big favour? And supporting us

Your friend claims to have "connections"

But if you don't send him money, his wife will go to jail.

What is happening here is simple.

They have dangled 1.6 million baht in front of your face. That's the carrot. They are now trying to extort money from you.

I understand where your coming from, but I was there when the Police worked out how much we had forked out to the hospital, and asked us what job my daughter had back Home and the timescale she expected to be ok, and he came up with a figure of 1.6million bhat, the driver would have to pay. He actually put it on the statement

The advice you have been given here is easy: get a lawyer if your own. You apparently disagree, why did you ask the question here?

Don't go on holiday without accident insurance.

Don't hire and drive a m/c unless your holiday insurance covers you.

I'm betting the girl has no m/c driving license, so the insurance company won't pay.

In which case asking the poor Thai to pay is a bit off.

PS. Never trust foreigners living in Thailand. They tend to be broke and living 'by their wits'.

I agree.

The problem is, he's thinking only about the (fictitious) upside - the 1.6 million Baht. He can't comprehend that 'connected' people don't get their wives thrown in jail if somebody from overseas doesn't start sending money.

This is why the best cons play on people's greed.
