Sunbelt....any chance on the OP applying for PR in the meantime (the December window for application is just around the corner) and so his long term status in Thailand can at least be sorted while he fights this thing. Or has that boad sailed now?

PR = Permanent Residency

Being on a Multiple Entry in Thailand even on long term does not qualify. Miniumum is 3 consecutive annual extensions. Also since not married to a Thai but application is rather made on base of work tax payments of a minimum monthly income of 80 K for three years is required.

In terms of permanent residency being here already long term is the smallest hurdle to take.

Thanks for your time Richard, but I don't think you understand my question. Although I have a multiple B my last entry was extended beyond 90 days because I acquired a work permit which will be canceled next week. Anybody know the definitive answer?

Rickly, does your (multiple entry) visa bear a used stamp and/or changed to a single entry that has been stamped used?

In the affirmative and you are not here on multiple entry anymore but rather single entry (invalidated multiple entry visa) with staying permit granted by Immigration within Thailand by procuring extensive indepth information on your employer (company registration, tax records, balance sheet etc.) than your stay loses its base when giving up your WP and you actually have to leave within 7 days.

What visa status is your stay here in Thailand based on? Still multiple entry still requiring visa runs or has your visa been used up when a staying permit extension was granted? If it is not multiple anymore than you will only be granted 30 days visa on arrival when travelling in and out because your visa status has lost its base when turning in the WP.

I was just wondering how they calculate what the actual monthly salary is in order to calculate any compensation due.

More than 10 years is 300 days wages for the severance

If its a basic salary.

It would be 75,000 Baht/30 days = 2.500 Baht daily wage

300 day's wages x 2,500 Baht daily wage=750,000 Baht

However if he recieved the following as part of his wage. These would be included as well.

Incentive Bonus

Thirteen Month bonus

Housing allowance

Car provided

Phone provided

Just depends on the contract and if these items were classified as a "wage" or "benefit" Lets say it was wage for 20,000 Baht month incentive bonus and the 13th month was 75,000 Baht would be worth 6,250 Baht. add 875 Baht per day = 262,500 Baht

Notice

Thai law requires a minimum of one payment period notice of termination or payment in lieu of notice of termination.

Example: He got his notice on Nov 2nd. He needs to be paid until Dec 31st

Add 150,000 Baht

Unfair Dismissal

If the company is found liable under unfair dismissal or defamation claim, the court may use his age, earning capacity and likelihood of the employee being able to find another job.

Example: The OP is 43 years old and it's hard for him to find another job. They may decide he cannot find a job for seven years and give a award of seven years salary which would be

6,300,000 Baht.

Total reward could be 7,462,500 Baht in this case.

He does not qualify. Needs to be here on three years of extension of stay permits.

A "big thank you!" again to all of you, especially to the sunbeltasia people, coming up with all this highly professional and informative support!

(I am very well aware that all of you may have a barn full, stacked with "thank you's"! but that is the best I am able to come up with in the very moment.)

But I think that you all can imagine how busy I' am right now sorting things out, finding a new place, a job, moving house....ahh, well changes.
