If the Director & Shareholder is Thai, does he count as 1/4 Thai staff for Workpermit?

Featured Replies

Hello,

As the topic states: If the Director & Shareholder is Thai, does he count as 1/4 Thai staff for Workpermit?

A small thing that I've been waiting to ask the right people for years, just never remembers to ask when I have the opportunity.

Does anyone here know?

A shareholder = no. A director = possibly.

If my Thai wife buys shares of a Thai company, she doesn't become their employee.

A director, however, can be an employee if they pay the correct social fund contributions. In Thailand, Director's are not obliged to pay social fund contributions, however if they do not pay they are not entitled to claim social fund benefits.
