This is just a quick question my wife who is Thai wants her daughters to come to UK for a visit round about Feb next year . That is no problem , but my wife has suddenly got paranoid that because her current visa runs out in April that her daughters would have there visa applications rejected . I think it won't affect their applications but could someone please give me a definitive answer .

When you say your wife's visa runs out in April, what do you actually mean?

 

Is she in the UK or Thailand, is she on Leave to Remain, is she on a visit visa?

 

If your wife is in the UK and hoping for her daughters to make a short trip, I don't really see an issue.

Not being pedantic, but your wife is on leave to remain rather than a visa, so it shouldn't really be an issue.

 

Your wife's daughter shouldn't have her application refused simply because your wife's leave to remain has to be extended.

 

The child, or mother, will need to satisfy the ECO that whilst her life is in Thailand she's going for a short trip to see her mother, that's not unreasonable, but she will need to satisfy the decision maker that on the conclusion of her holiday she will return to Thailand.

 

It's often complicated when mum has a new life in The UK and the child has remained in Thailand.

 

There's so many things to be considered, the child's age, the length of the trip, who she lives with in Thailand etc etc.

As theoldgit says, that your wife's FLR expires and she will be applying for ILR in April should have no effect on her daughter's visit visa application.

 

How old are the daughters? 

 

If under 18, who are their carers in Thailand and what are their reasons to return to Thailand rather than stay in the UK with their mum?
