like most people trying to get a visa for their thai girlfriend I have a few application specific questions as most of them were answered reading or following https://clearsunisa.com/how-to-get-australian-visa/

 

Background:

We met 6th July (2.5 months ago) and have slept together every night since (installed a camera in living room with evidence, plus chat logs and photos)

She is 28 and unemployed so financially dependent on me

She has had a passport for 4 years and travelled many places in Asia eg. Laos, Philippines 

I am an Australian Citizen

 

Now, according to FAMILY LAW ACT 1975 - SECT 4AA a de facto relationship definition is found here http://classic.austlii.edu.au/au/legis/cth/consol_act/fla1975114/s4aa.html and I despite the fact that we will have only been together for just under 4 months before she flies to Austalia there is enough evidence for me to claim that I am her de facto partner (common residence, sexual relationship exists, degree of financial dependence, the care and support of children, etc) and sponsoring her trip to Australia to visit the family, visit wineries and get another METV for me together. You need de facto 12 months before applying for partner visa but this is just for 3 month tourist visa.

 

I am willing to roll the dice on "genuine tourist" as our relationship is genuine, I have more than enough finances plus depositing 30,000b in her bank account for emergencies, and flight risk is low given previous international travel plus my intention to return to thailand with her.

 

2 Questions:

Application is being made online (faster processing time) and there are a few things everyone must have done but I can't seem to find answers for:

- I attached photos of everything (signed photo, passport, ID card, etc) but do you ever need to hand in "certified copies" if doing online and if so do they do it at the AVAC soi 13 Bangkok when you do the "Biometrics Collection Only"?

I can't give any advice on that but just to tell you how hard it is, my lady friend 

applied for a tourist visa (she is 50 years old) she has a house in her name

has 12 rais of land  has a business has 2 children I sponsored her and she got refused

the first time I sponsored my(now ex) wife on a spouse visa it took 9 months but

eventually she got it

you don't sleep in the living room, that's what the bedroom is for... I set it up encase my shady russian landlord decided to invite himself in or come around unannounced (again)

TBH, I think you will be pushing poo uphill having only known her for 2.5 months.

 

Forget about the Family Law Act, it's totally irrelevant.

 

If you could hang on until the relationship is at least 6 months old, you

will have a much better chance IMO. There's no official time limit on these

things, but Immigration are known to want a bit longer than that a few months.

 

Depositing 30 000 Baht into her account won't matter one bit.

In some cases it can even be a hinderance as Immigration will know

where it came from.

 

Not having a job isn't ideal, but it's not a deal breaker.

Travelling with you and back helps.

 

It's only about 3000 Baht if you lodge without an agent so if you're keen, you

might as well give it a crack.

 

I'd be waiting a bit longer though.
