Cabinet endorses abortion bill allowing termination up to 12 weeks of pregnancy

 

 

The Thai cabinet has approved amendments to the abortion law, to allow a woman who is no more than 12 weeks pregnant to have an abortion.

 

The bill to amend Sections 301 and 305 of the Criminal Code corresponds with a decision by the Constitutional Court, on March 3rd this year, which ruled that the two sections forbidding abortion amount to an unnecessary restriction of the rights and liberties of women.

 

Ms. Ratchada Thanadirek, deputy government spokesperson, explained that the 12 weeks is to be determined by medical professionals, under the guidelines set by the Medical Council, and is regarded as a safe period during which to have an abortion.

 

According to the amendment to Section 301, the penalty for women who have an abortion after 12 weeks of pregnancy has been reduced from three years to six months, and the fine has been cut from 60,000 baht to 10,000 baht.

Bottom line for me? Should I and my significant other be faced with this decision, I would not recognize any law, regulation, disapproval by the right wing demanding that we carry to term, deliver, care for and bear the emotional/financial burden of raising a genetically damaged being. Fortunately, I would have the financial resources to seek medical care in an enlightened country. Foolish to follow an absolute stance, based on personal religious beliefs (and trying to force those beliefs on others), and yet refuse to have social systems in place to care (emotionally and financially) for those who choose not to abort.

Cabinet agrees to amend abortion law to protect women’s rights, ensure safety

The Cabinet has agreed to amend the Criminal Code making it possible for women to terminate their pregnancy of up to 12 weeks, government deputy spokesperson Ratchada Thanadirek said.

 

This decision has been made based on recommendations offered by the Medical Council and the Royal College of Obstetricians of Thailand.

 

Before this, women were legally allowed to abort pregnancies of up to three months, but had to seek a doctor’s approval for foetuses any older than that.

 

Now, however, it has been determined that it is safe to abort foetuses of up to 12 weeks without the risk of complications or risk to life.

 

Meanwhile, the penalty on illegal abortions has also been reduced because the mother suffers both physical and emotional pain when undergoing an abortion.

 

The amended law reads as follows:

 

Section 301: A woman who aborts a foetus that is older than 12 weeks shall be liable to no more than six months in prison and/or a fine of Bt10,000.

 

The penalty for this originally was up to three years in prison and/or a fine of Bt60,000.

 

Section 305: The offender is not guilty if:

 

• The pregnancy puts the mother at risk physically or psychologically.

 

• The baby faces a significant risk of developing physical or mental disorder or disability.

 

• The woman has been impregnated due to rape.

 

• The mother-to-be is convinced there is no other option.

 

The amendments will be submitted to the Coordinating Committee of the House of Representatives before being proposed to the Parliament for urgent consideration, so it can go into effect before February 12, 2021.

It's a start. My home country has no abortion prohibition laws. I think it should entirely be left to the woman. Keep religion to hell out of it.

About time get with the times, there are to many backyard unsafe abortions going on in Thailand it is a massive problem needs to be legalized and controlled properly
