The Thai Visa member “click2cancel” posted on May 11 very worrying information about the October 1/07 withdrawal of the “grandfather” rule for the marriage visa, triggering so an avalanche of 104 worried reactions on 7 pages. This suddenly ended on May 15 when Sunbelt delivered the statement that the grandfather rule will work also after October 1/07

Yesterday a friend of mine, on marriage visa, went to Nong Khai for the visa renewal

And he was clearly informed that when he will apply again next year, he would have to show only a monthly income of 40,000 Thai Baht per month. Yes it can be produced by him and his wife together but I don’t know of any Thai wife producing any kind of income to be added to that of her foreign husband.

He can meet the 400k Bank deposited for 3 months rule, but he has to wait for another 3 years to get the pension. He has legally married a Thai lady, he has bought a land and has constructed a nice home, all of course in his wife name, but the Immigration Officers told him that if next year he does not show an income of 40k per month he must leave the Country.

And what will happen to the retirement visa? If one can show a 3 months Bank deposit of 800k but cannot show a monthly income of 65k?

I believe his information is based on a one year delay provision (quote 2) - the grandfather provision of 400k meeting the marriage provisions (quote 1) is part of the law and should not have any such limitation.

(6) In case of the applicant who is

married to a Thai wife, one of them

or both of them need to have the

total annual income that is

averaged out not less than 40,000

Baht per month. Except for the case

that the said foreign national has

entered Thailand before this Order

is enforced and the foreign national

has been permitted to stay in the

Kingdom by the result of having

married to a Thai wife, then if the

applicant does not have the said

income, then, the latest 3 months

records of the account book of any

Bank in Thailand with the account

name of either or both parties need

to have the amount of money not

less than 400,000 Baht.

Provisional Section

13. Within 1 year from the enforcement date of this Order, for the case of the foreigner who has entered

Thailand and has been granted to stay temporarily in the Kingdom of Thailand before this Order will be

enforced and disqualifies to the criterions set forth on this Order, the Commander of the Immigration Bureau

or the authorized officer shall be responsible to consider granting the permission, based on the necessity of

the applicant, case by case.
