Foreigners running workshops/seminars in Koh Phangan - do they need work permit?

No, Working is defined in the labor law, which is very clear and leaves no room for interpretation.

Yes, most of them are working illegally.

Look like you keep asking to find somebody to tell you that you can it legally, which you can't they way you like to do it. For a work permit you need either being employed or have your own business.

To get a work permit for while having your own business you need to employ 4 Thai staff for each foreigner you employ, including yourself.

As said above, there is a exemption specifically for seminars/lectures etc.

Why does it matter, are you assuming that they don't have work permits?  Are you planning on reporting them?

  • They are still working so need a work permit, even for voluntary work

  • Yes they should have a work permit, it most certainly is considered work

Can you give a link to the law where that is stated please.

It wasn't issued as primary law. Instead, based on the opinion of the Council of State, the Department Of Employment issued a Notification in March 2015, specifying the following activities would not considered as ‘work’:

1. Attendance at meetings, discussions or seminars

2. Attendance at exhibitions or trade exhibitions

3. Visits to observe businesses or to meet for business dialogues

4. Attendance at special lectures and academic lectures

5. Attendance at technical training and seminars

6. Purchasing of goods in trade exhibitions

7. Attendance at board of directors meetings of one’s company

Where is the definition of "occupation" or "job" then?

Sunbeam, let's make it simple for you, if a Thai can do it, you can't, unless you have got a work permit.......????

There is an exemption for attending, not for organising, conducting or speaking at the same.

Consider foreign musicians and performers who enter Thailand to sing in a concert or act in a play.

Such artistes apply for a 15 day urgent work permit which allows them to perform at their concert venue for reward.

I don't care if it's technically illegal as long as it's widely tolerated. Prostitution in Thailand is illegal too, but who cares...

This is a newbie mistake. People assume that because the lines aren't where they expect them to be they can do what they like - there are lines and if you cross one of THEIR lines you will know about it.

No, legally you can not.

Ah, ok.   When is your seminar, then, and what's the subject?

Where is the definition of "use"?

Where is the definition of "strength"?

Where is the definition of "intention"?

Where is the definition of "other"?

Where is the definition of "definition" (regarding Thai labour laws)?

It is work and they need a work permit and the appropriate visa.

Unless they're exempted.  Let's be accurate.

Anybody wanna muddy up the waters by mentioning the companies that exist to "hire" foreigners, charging them a fee to keep them legal (including paying taxes so they can renew their WP each year)?

Edit:  I never used one, so I don't claim to have details.  But they seemed to be real popular with digital nomads before Covid.  As I recall, some of them also provided shared workspace.

Work is what you do at your job. A job is a place where you work. Any more questions?

"Any more questions?".

Yes, how can a 'place of work' be a 'job', surely it would just be a place of work?  None of my jobs were ever the offices I have worked in.

Any more answers?

Isn't it clear?

Running a workshop is "work".

The event site would be your "job".

You need to clarify that inane ''definition.  An event site is a place, a location, not a "job".

Somehow I doubt that anyone running seminars in Phangan has a work permit.

So what...how can it matter so much to you?

Boycott them, then!

Maybe this thread is just your sneaky way of reporting them!

Except that cute one with the red stretch leggings.

Thank God Liverpool Lou has come onto the thread and sorted this all out.

Yep. Just like reporting Pattaya beach prostitutes. Police will be shocked when they find out!

Well, one of the meanings of the word "job" is a location where you work. "I arrived at my job."

Depends on your understanding of the English language!

Much appreciated.  There are a lot of others who are thankful, also.

How would that be classified as being illegal?

Really?  Where is that specifically stated that organising or speaking at is not included in the exemption?
