If I have an extension of stay based on marriage and I reside in Thailand for the year, is it permitted that I can work as a freelancer/self-employed from the US. 

 

I know it’s forbidden to work within Thailand without a work permit, but is it permitted to have income from my business that is taxed in the US?

 

I’m hearing contradictory information on this..

Yeah, I get that. But with this new tax law being discussed, I didn’t know if it would lead to more poking around for money trails if I was to do it

As long as no money passes through a Thai bank you will probably be beneath the radar. 

I've been selling online for avout 12 years without any issues.

This is a frequently asked question. Usually, it is worded "does Thailand allow digital nomads?"

 

The short answer is that, as long as you have no Thai employer or customer, it is officially not allowed, but is in practice 100% tolerated.

Nothing is definitive yet, speculation is pointless, but double taxation treaties are in place, so you are not likely to be liable.

You can work online in Thailand without work permit as long as you:

 

1. don't do the online job that a Thai can do : example : do a reportage of a temple, etc...

2. don't harm the Thai economy and society with your online pro activities : example no porn, no concurrency

3. you are not paid on a Thai bank account from a Thai registered company

Don't tell anyone and/or don't make any enemies and you'll be fine. The jury is out on whether you'll be 100% legit. But you'll be fine.

It will still be illegal.

In principle it's forbidden to perform remote work without a work permit – however, there seems to be some (numerous) doing it under the radar; there is a newer proper visa for that purpose, but quite strict with both income and employer – while you can have whatever income you wish from abroad.

 

If foreign income is not covered by a Double Taxation Agreement you shall from January 1st next year (2024) pay personal income tax of all money transferred into Thailand.
