Ok, but how is that relevant? This is not a First Amendment issue. 

 I doubt very much that the Congressional Representative approved, let alone was aware of the  image. Even if he was in agreement, he had no legal right to post the image. And yes, the Congressman is responsible since the person alleged to have posted the image was his employee.

The Congressman and his staff occupy private space under the control of the Chief Architect's Office. There are rules and regulations in respect to artwork and other displays. Artwork and displays must adhere to the policy of the House Office Building Commission (the Commission). Exhibits depicting subjects of contemporary political controversy or a sensationalistic or gruesome nature are not allowed. Nor are altered images or unapproved designs of the US national flag or other symbols allowed.

Yeah, all the Democrats openly supported the KKK back then. They have to keep it on the downlow nowadays.
