1 Year Lease Agreement - continuing on a month by month basis?

If you sign a condo lease agreement for 1 year, after the 1 year is up, is it possible to continue on a periodical lease or continue on as a month by month basis on the same terms & conditions as the original lease and only give a month's notice prior to vacating? What actually happens in Thailand once a 1 year lease agreement is over and a tenant wants to stay on, but doesn't want to sign another 6 or 12 month lease extension?

Entirely up to you and the Condo owner/Agent. If it suits the owner he/she will do it, if they want long term, then they won't. No Thai Govt laws or regulations to worry about. Remember that the deposit does not cover the last months rent, unless stipulated in the Contract.

PS: I have done this before (as the owner), but I always take 2 months deposit.

How much do agents charge the landlord on the signing of a 1 year lease agreement, one month's rent? Is it the same if it was only a 6 month lease?

 

Also, say there's a 1 year lease that's finished and the tenant wants to sign another 3 month lease, what commission would the agent usually get for the extra 3 month period?

    What happens after the 1 year lease is up should be clearly written in the rental contract and agreed to by both parties.  I would not bank on anything that isn't in the contract.

the agreement should say, what does it say? 30 days is standard

usually one year = one month

and then prorated down.

I never use agents..do all myself..contract is my own and covers everything that I think necessary and important.

As others have also said, it is up to the owner/agent to let you negotiate a new short term contract, but it would normally be the same conditions and as short term they add extra clauses. Nobody here can really answer your questions 100%, as all rentals/leases are different and with different owners/agents.

Just take what myself and others here have told you and work out the best deal you can.

As an example, is it possible to have a lease drawn up as a one and a half year lease, however, the tenant is able to give one month's notice to vacate anytime during the lease agreement after the initial 6 months of the lease has been fulfilled? Tenant will get a full refund of their deposit when they vacate. So in effect, although the lease is for 1.5 years, the tenant is free to leave after 6 months with no penalty.

As I have posted (and others have said) everything is possible..it is just between you and the owner/Agent to agree (or not). Over the years I have made many different contracts/leases on my properties, but they will always favour me for whatever scenarios a prospective tenant might propose. If I don't like his idea, or he doesn't like my counter offer, then he can find another property.

You don't need to ask about possibilities again as it has now  been explained to you. Find your desired property and make your proposals. Good luck.
