BMW Driver Faces Jail Over Crash That Killed Mother & 2 children

The Chumphon Provincial Court has sentenced a BMW driver to four years and seven months in prison for causing the deaths of a mother and her two children in a high-speed crash in November 2024. The court also allowed the defendant temporary release on bail during appeal, requiring an electronic monitoring (EM) device and prohibiting her from leaving Thailand.

 

The fatal collision occurred on the evening of 27 November 2024 on a rural road in Tak Daet subdistrict, Mueang district, Chumphon province. The BMW struck a motorcycle, instantly killing 52-year-old Ms Yenchit and her two children, Kritmet, 16, and Boonyanuch, 14. The victims’ husband and father joined the public prosecutor as a co-plaintiff, initially seeking damages of 24.2 million baht.

 

According to the court, the defendant Ms. Jiranthanin, initially denied some charges, claiming contributory negligence by the victims, but later changed her plea to full confession. She entered into a settlement agreement with the co-plaintiff to pay 5.5 million baht in compensation, of which 500,000 baht has already been paid. The remaining 5 million baht will be paid in monthly instalments of at least 30,000 baht. The vehicle’s insurer, Falcon Insurance Public Company Limited, has also compensated the victims’ family with 4.5 million baht.

 

The court found the defendant guilty of multiple offences under the Criminal Code, the Road Traffic Act and the Narcotics Code, including driving under the influence of alcohol and methamphetamine, reckless driving causing death and failure to stop to provide assistance. She was sentenced to six years in prison, increased to nine years under Section 160/3(2) of the Road Traffic Act, before being halved due to her confession. The final sentence amounts to four years and six months in prison, plus one month for failure to assist and a fine of 500 baht for driving without a licence, totalling four years and seven months’ imprisonment.

 

The court noted that the defendant’s actions were serious, involving high-speed driving while intoxicated and under the influence of drugs, leading to three fatalities. It stated that she had shown limited remorse and attempted to flee the scene. Despite partial compensation payments, the gravity of the offence ruled out a suspended sentence. The court also ordered the confiscation of the BMW vehicle used in the crash.

 

After sentencing, the defendant applied for temporary release pending appeal. The co-plaintiff did not object, and the court granted bail set at 150,000 baht. The defendant must wear an EM tracking device, remain within Thailand and inform the court of any address changes. Both the prosecution and the victims’ family retain the right to appeal the verdict.

I know, Sadly, it is not unusual, even in somewhere like Australia, for people to receive manifestly inadequate sentences for killing others in car crashes.

This seems to be a thing in Thailand. Do insurance companies in other countries pay out when a driver is DUI or unlicensed, as they seem to do in Thailand? In Australia I'm pretty sure the insurance of the driver would be voided.

This is third-party liability coverage (which covers injury or death to others) still apply in some cases.
However, it's certain the insurer will get reimbursement, likely suing the driver to recover costs.

Even in Australia the insurer might pay victims first, then recover costs from the driver.

Sorry, but 4 years and 7 months for killing a woman and kids through dangerous driving is BS. It should have been at least twice that with no parole plus financial compensation. Talk about a soft sentence for the rich... that bad optics.

Although you would not suspect it. There are many wealthy in Chumphon. Perhaps her family is helping with this. How she can pay monthly installments while in prison?

Curious to know how old the BMW driver was?  eg:- If early 20's the BMW and her 'entitlements' have come from mum and dad?  Reeks of spoilt out of control brat.

I was under the impression that driving under the influence of drink or drugs negated your insurance .

that's 167 months, or about 14 years. Good luck actually getting that "compensation"

That is the problem here, halving sentences here when plead guilty, that's 10 years for murder and time off for good behavior, so out in 8 years, I'm sure its to save the cops time/work in finding the guilt, even when all the evidence is in plain sight...

Ten years is what she likely deserved, but four years is more than some of the infamous cases of the past. Anyone who has spent time in Thailand will remember the Bangkok Expressway crash about fifteen years ago, where a wealthy teenage girl caused a crash that killed nine people in a minibus. I don't think she even completed the community service order she was sentenced to. She didn't pay compensation or even apologise according to the families of the victims. 

 

If you kill people in a crash and are unlicensed, drunk, or drugged, ten years should be the minimum sentence unless the other party contributed substantially to the crash.

No licence, speeding, pissed & high, failure to stop & assist - impressive rap sheet! Just over 4 years for killing 3 people because she confessed & surprised the insurance paying out, guess it's the vehicle insured not the person - mind boggling Thailand

She should get jailed for life. The hypocrisy of Thai law displayed yet again. Four years for killing three people, disgusting. I hope her life will be a miserable one.

I agree.The sentence she got was rather light. Yet in another similar case, being the Red Bull case who is still able to avoid arrest and live a life of luxury who was was driving with drugs and alcohol in his system , ran into and killed a police officer on his motorbike and then left the scene. He hasn't spent one day in jail and that was a long time ago. Why? because he has very very  deep pockets and the authorities have many envelopes!

The culprit can afford to pay £750/month in compensation/damages.

In any sphere thats a lot of cash each month, so she's bribed the system in the good old Thai way yet again instead of facing a dank cell in a miserable jail as the consequence of her actions.

Disgusting Thai ethics and morality yet again.

So you are under the illusion it's okay to have ANY alcoholic drink before driving. Why would you? Any amount of drink impairs ability - and you acknowledge that. It is not ONLY speed that kills.

Its manslaughter x 3 isnt it, a very light sentence for killing 3 people will DUI and high on illegal substances.

How long did the owner of the bus company get for burning, remind me was it 23, children and teachers to death?

It is stalling tactics. The family of the deceased would be forever chasing payments. How much would the BMW be worth? It looks like a very modern late model.

I suppose that other penalties are considered, to make the jail term shorter;
