Work Permit / Visa Relationship, Simple Question

Hi all,

In a previous thread:

I asked about what happened to my multi non imm B visa when my WP is cancelled. The result of that was I just revert back to crossing the border every 90 days and the visa is still valid until its expiry date.

But HR at me company called immigration and they tell me that I have only 7 days to leave and get a new visa.

Sorry to keep harping on this but can someone clear this up for me please?

In the other thread you indicate you did not extend your stay on the basis of your work permit but now you talk about reverting back to 90 day runs so you obviously did extend your stay or you would have always have had to do 90 day runs. And if that is the case you are on an extension of stay and will have 7 days to exit the country as you have been told.

Remember when talking that a visa is issued at a Consulate but immigration issues an extension of stay or changes the category of a visa only.

I think you would have 7 days to get a new visa only if your origional non im visa had expired and you were now staying on the extension granted due to your having a WP.

If the extension is cancelled but your nom im visa is still valid then you will revert back to this.

Please correct me if I'm wrong someone.

If he is on an extension of stay he does not currently have a valid 90 day entry stamp and must leave the country to obtain one.

ok he has to leave the country but upon his return he will be granted a 90 day stay on the bases of his not yet expired non im, correct?

Correct. But now he says he did not get an extension. But if he has been here more than 90 days continuous he must have received one. In any case I would not want to argue now that immigration has said he must leave. I would leave and if multi entry visa is still valid come back on it with another 90 day stamp and keep everyone happy.
