Wife's Liability

Can anyone confirm the position on marrying a Thai lady. If she has any liabilities (i.e. monetary) do these pass on in marriage to be the husbands responsibility. Also are these liabilities generally chased up once the marriage has taken place?

Any body got knowledge on these things. Thanks

To get your answers, you need to read:

The Civil and Commercial Code of Thailand Book V: Family, Chapter IV: Property of Husband and Wife, Sections 1465 - 1493, inclusive.

In particular, Section 1488 of the CCC, which reads as follows:

Where either spouse is personally liable to perform an obligation incurred before or during marriage, such performance shall be first made out of his her Sin Suan Tua; if the obligation is not performed in full, it shall be satisfied out of his/her portion of the Sin Somros.
Sin Suan Tua = personal property acquired before/after marriage - see Section 1471 of the CCC;

Sin Somros = property deemed to be marital property as defined under Section 1474 of the CCC

Section1489

Where both spouses are common debtors, the performace shall be made out of the Sin Somros and the Sin Suan Tua of both spouses.
