Hi

I am getting married to my girlfriend in january who i have been with for 2 and a half years now.

My questions are

- We intend to go to England next year proberly around march, april

- She is also 2 months pregnent as of today

- I will work for my brothers company for around 4-5 months in England

- Our child would then be born in England

- I own a home and have finnace to look after her etc

- I want to stay in England for 8 months and come back to Thailand for the cold 4 months

To get to the point what is the best way to go about it?

I have read other threads ect and have a bit of an understanding of what the Embasy is like. But i am a straight to the point guy a sincere guy but am unsure the best way to go about it ie:

Do i tell the Embasy shes pegnat etc

Do i tell a few white lies ie: shes not pregnent and just apply for a 1 month visa then apply with the thai embasy when in England for an extension. Or be straight up apply for a settlement visa or 6 months visa.

At the end of the day i just want to stay in England while the child is born and do 8 months in England and 4 months in Thailand each year to make some money as i have achild on the way and Thailand is hard to make money and support our selfs.

What differance does it make we are married and have a child compared to just having a girlfriend????

As mentioned i am straight to the point type of guy and am going to have a wife and child in the near future and just want to be with them and not have to go home alone to make more money.

Please could any members with Knowalge of how this works give me the options and best way to go about it. if i can i would like to do it right but if it comes to it i will tell a few white lies to get what we want as our lifes are more impotant than a officers decision on what is best for us.

Look forward to any replys and help with my situation

If you are marrying and having a child, then the best option would be a spouse visa. This is a visa for settlement in the UK. It lasts for 2 years and at the end of this she can apply for Indefinite Leave to Remain. There is no hard residential requirement for this, but she will need to show that she intends to reside in the UK permanently (she can always change her mind later :o ). I cannot see that spending 4 months out of 12 in Thailand would be a problem here.

Do i tell the Embasy shes pegnat etc

ALWAYS TELL THE TRUTH!

What possible reason is there to lie? BTW, the minimum period for a visit visa is 6 months. The Thai embassy in London have nothing to do with UK visas.

I suggest that you read the following:-

Guidance - Husbands, wives and partners

If the child is born in Thailand, then the following is also very important:-

Consular Birth Registration

If born in the UK, similar registration at the RTE in London would be a good idea.

Hi thank you for your reply and the info i have read and it was most helpful,

I have just read many of the posts and see getting to England is a bit of a nightmare. All i want to do is get there and not have to mess about to much.

Regarding the spouse Visa do i need to prove we have been together 2 years etc?

Also can you give me a bit of info on what is needed etc. I have a home etc in England and the funds to support ourself's.

Our child will be born at the end of July so would like to be in England for the Birth otherwise it will mean staying here until the child is able to fly.

What are the timescales involved in the application? and again if refused first time how long again for the appeal or second application.

Many thanks

The current waiting time for an interview is, according to the embassy website, is 8 to 10 weeks.

However, if you submit all the supporting documents with the application, and if those documents satisfy the ECO so that s/he is "minded to grant" the visa, then she may be contacted shortly after submitting the application and told she can attend the embassy at her convenience. This is known as a short interview, and after being asked a few questions at the counter she will, provided her answers are consistent with the application, be asked to return later that day, or possibly the next, to collect her visa.

One important point. TB testing. This must be done before submitting the application, and the results submitted with the application. Failure to do so means the application will be refused and the fee forfeited. One of the requirements of the test is a chest X-ray, but she is pregnant. I have absolutely no idea how this would affect things. They may say that as she is pregnant they will forgo the X-ray, and rely on sputum smears. I suspect that this would be the case, but they may say that she must have an X-ray and so will have to wait until after the baby is born. I suggest that you contact the embassy and find out PDQ.

As far as the application and supporting documents go, I would direct you to Build Your Own Settlement Visa Supporting Evidence Folder on the Thailand-UK site. This is in the Members Only section, so you will need to register with them to view it, but it's worth it as it covers all the angles.

Good luck, and any further questions, feel free to ask.

BTW, getting a visa is not a nightmare, provided you satisfy the criteria and provide the evidence of this. Remember, in 2004/5, 94.1% of visa applications to the British embassy in Bangkok were successful.

Sounds good!!!

I will go through all the info you have advised to read and contact the embasy and explain my situation to them to find out how to go about things.

I have been worried as many posts go on about how the Embassy is a nightmare it is refreshing to hear that the application should be ok providing we complete the application correctly.

Once i have everything in place i will send you a message if thats ok :-) with all the evidence and paperwork i have before submitting the application just to try to make sure i have not missed anything in your opinion.

Thank you for your time and knowlage it is much appreciated and also thank you for all the help i see you have given other members on this forum. I am sure a lot of the success rate is partly from the help members like yourself have given with the visa applications.

Have a very good christmas and new year!!!!

Thanks so much again
