I have been in a relationship with my girlfriend for 6 months and during this time I stayed with her in thailand for 2 months on 2 separate visits

She is unemployed and lives with her 3 year old daughter and I am supporting her financially

We applied for a 3 month tourist visa for her to go Australia (without her daughter) after we had been together for 3 months and it was rejected - the usual reasons - not long enough, no incentive to return etc

Now she cannot come to Australia without her daughter coming

The Thai father has agreed to sign a letter of approval for the daughter to travel

Is it possible to get a 3 month tourist visa for both her and her daughter - or is this not likely to be approved?

The only other way is to wait until we have been together for 12 months and then apply for a spouse visa

Or do you have to first get the 3 month visa and then the spouse???

Any comments would be of help

I don't know too much of the Aussie rules, but working on the basis that they are broadly similar to those of the UK, I would think that the visa might well be declined again. Whereas you've now known each other for 6 months, you would now be applying for the daughter to go too, and your girlfriend has even less incentive to return to Thailand at the end of her holiday.

You are pushing it too hard and quick...even after only 6 months it is unlikely to succeed especially with the daughter included and after you have been declined once before. Look at it from their side of things, you applied after knowing her for only three months and then again three months later with the daughter included, what do you think they would assume? and thats all they need for a refusal is an assumption.

I would wait till you have known her for at least 12 months now, supply more documents of continued support, letters, e mails and phone calls...go and visit her again and get photos taken with her and her family. Get the letter from the father and it must be a certified english translation, keep the Thai copy for the immigration at Bangkok airport when they leave, they will want to see it. Also get letters from her family, again certified english translations, attesting to her good character and any reasons why the child cannot stay in Thailand while the mother is away and get a JP signed Stat dec from you stating that you intend to bring her for a holiday only, that you will provide all financial, medical and general living expenses for her and that you will ensure that she abides by the conditions of her visa while she is in Australia. Because you have been declined already, your next application will need to be super strong.

There is no need to get a tourist visa first before applying for a Spouse/fiancee visa but by bringing her out for a holiday first, you are showing that you have spent time together here which helps to prove an ongoing relationship and that she will then have a travel history. This helps when you do apply for the Spouse/fiancee visa.

thanks for the advice

I think I will try and get my girlfriend to leave her daughter with her mother and come on a 3 month tourist visa. If she needs to go back home early to be with her daughter then thats ok. At least we will spend some time together in australia before we try for a spouse visa later on
