KMC LOAN

Supreme Court to try Thaksin

The Nation

BANGKOK: -- The Supreme Court's Criminal Division agreed to the trial of former prime minister Thaksin Shinawatra and 27 accomplices, implicated in Krungthai Bank's fradulent lending to Krisda Mahanakorn Group (KMC).

Defendants are summoned for the first testimony on October 11.

Aside from Thaksin, the other defendants included Viroj Nualkhair, former president of Krungthai Bank, and executives of KMC Group. They were charged of violating the Criminal Code’s Article 157, Commercial Banking Act BE2505, the Securities and Exchange Act BE2535 and the Public Company Act BE2535.

The state prosecutors viewed that when these persons were in power, Krungthai Bank approved loans to KMC Group despite the group’s poor financial position.

It loaned Bt500 million to RK Professional Co Ltd and Bt9.9 billion to Golden Technology Industrial Park Co Ltd. The prosecutors viewed that the persons conspired or supported the fraudulent practice at the state-owned bank, to benefit KMC Group and themselves.

The loans were approved when Thaksin was in office.

What will be the verdict if Thaksin is a no-show.

Is he, by default in contempt of court?

Is the Supreme Court - Criminal Section a Judge only court or Judge and Jury Court?

As a common sating goes ... "It's a brave and bold more to Trail Him"

Which I am sure that it is what The Nation meant with it's Headline ...

"Supreme Court to try Thaksin"

... because Thailand tried Taksin once before with mixed results ... ermm.gif

And if Thaksin is charged, tried, convicted and sentenced will he serve his jail time in the same way Sondhi is serving his?

except he can not be charged etc etc because Thaksin is not here. At least Sondhi is. (though Sondhi is just as big a <deleted> as Thaksin)

As far as i'm aware Thailand does not have a jury system.

At the very least Sondhi is in Thailand and legally out on bail.

Thaksin isn't in the country and skipped his bail.

Actually this seems to be a most appropriate time to hear all those other cases against him. He can be found guilty in all of them and then the PTP can push for an amnesty. Clean slate with nothing waiting in the wings to cause him any trouble.

Sondhi did appeal....so he isn't convicted yet.

Thaksin already has been charged, tried, convicted and sentenced. His response was to run away.

Didn't know Sondhi also was a part of this scandal.

Correct, Sondhi was convicted in another fraud case

The Security and Exhange Commission accused him of falsifying documents used as collateral for a loan amounting to almost 1.1bn baht ($36m, £22.7m) for his media business.

The point is that Sondhi is still leading his band of "geriatric terrorists" despite facing a 20 year jail sentence for fraud.

This is of course 'politically motivated' and taken care off by the coming charter overhaul.

Right actually having the will to charge him with a crime MUST be politically motivated.

Because other wise it would be politically motivated to let him get away with it.

'Politically motivated': It is the only catch phrase he has to even attempt

getting the world stage to believe he is a poor persecuted man post coup,

and not removed because he was demonstrably more corrupt ongoing,

and had suborned the wheels of justice more than any other before him.

The key question is whether or not any of these guys repayed the loan. In Sondhi's case I believe he did. In thaksin's case I believe they let the company go bust and the 9.9 Billion was 'gone". Very different case in my opinion.

Correct me if I am wrong.
