Charter change petition based on Article 154 rejected

BANGKOK: -- The Constitution Court on Wednesday ruled to reject the opposition's two petitions, both of which cited Article 154 to question the charter amendment bill.

The court said the petitions did not merit the judicial review because Article 154 had no bearing on amending the charter.

The ruling means the charter court would only review cases based on Article 68. The opposition contends charter change on filling senatorial seats has been designed to overthrow the political system.

Constitution Court rejects charter change petitions
By English News

BANGKOK, Oct 9 – The Constitution Court today turned down national legislator petitions seeking its ruling on the legality of the parliamentary-approved charter amendment.

Democrat MP Jurin Laksanawisit, opposition chief whip, and appointed senator Paiboon Nititawan, separately submitted their petitions to the court, asking it to decide on a section in the constitution amendment which paves the way for elections of 200 members of the Upper House, and not appointed in part as required in the current charter.

The petitioners asked the court to take their complaints into consideration in accord with Section 154, Clause 1 of the Constitution.

The court said the petitions failed to meet the criteria of the Constitution, reasoning that complaints against charter change must be made under Sections 150 and 151, not Section 154, as stated by the MPs and senators.

The bill on charter amendment was earlier passed in its final reading by Parliament and the government was in the process of submitting it to His Majesty the King for royal endorsement. (MCOT online news)
