Lawyer calls for Chalerm to be arrested

BANGKOK: -- A lawyer called yesterday on a court to issue an arrest warrant for Chalerm Yoobamrung, in his capacity as chief of the Centre for Maintaining Peace and Order (CMPO), for going ahead with the deportation of Indian businessman Satish Sehgal.

Chalerm recently signed an order to deport Satish, president of the India-Thai Business Association, for allegedly inciting illegal activities under the emergency decree and leading members of the People's Democratic Reform Committee (PDRC) in raids on several state agencies.

Wanthongchai Chamnankit, who also represents PDRC co-leader Thaworn Senneam, said yesterday that Chalerm clearly violated the court's February 19 ruling barring him from enforcing several measures under the decree, including the deportation of foreigners.

The court has accepted Wanthongchai's petition and will hold a hearing on March 25.

Don't know Chooka, but the courts brought in a rule in FEB , that this guy thinks Chalerm has ignored ,the ruling includes the deportation of farangs, who can , who can't, Chalerm apparently can't

I don't know if Satish did these things, it is of no real consequence to me. If he did, let the courts or which ever government agency is responsible rule on the issue. What does concern me is the patent disregard PTP has for the law. We won an election, we can do whatever we want is the attitude, laws are for the protection of everyone and must be respected. When Chalerm disrespects a court ruling he should be punished. The government has ignored the Constitution, the courts, the laws and wasted the peoples money, be gone I say.

What I mean Thait Spot, is the easy access to "user-friendly" courts for PAD-Dem's.....They can come up with any challenge to the PTP elected Govt., and their courts will accept them.....Even when it is clearly Opposition folderol one would expect from any Opposition-type circumstance in a Parliamentary Democracy.

The Judiciary in effect enables what ought to be challenges in Parliament, via the courts.

It gives the Opposition relief outside parliament....Exactly what the unelectables want.

It would be more proper that they be turned back by this judiciary, and told to take it to Parliament.....And then when they bleat "Parliamentary Dictatorship", they be told to adapt themselves to a diverse Thai electorate and win an election. That way they can establish their own "parliamentary Dictatorship".

I have no problem with an electoral majority enacting an agenda and policy platform on the basis of which they have been elected. ....If some want to call that "Parliamentary Dictatorship" so be it......Works fine in the Parliamentary systems of Australia, Canada, England, etc.......And sure beats the USA system of congressional gridlock.

I think the problem is that due to a court ruling he should not be deported so that's the law. I'm not saying that's right and without looking into it more it does seem strange. The thing is you can't enforce one rule by breaking another and by doing this it will just add to the impression that the PTP only obey laws they like. Better to back off and wait. Much better PR.

I don't know if Satish did these things, it is of no real consequence to me. If he did, let the courts or which ever government agency is responsible rule on the issue. I'm amazed Farangs are so confused about the prerogatives of an elected Parliamentary majority......

Unless we are dealing here with agenda.....Like the saying goes, "When agenda walks in the door, common sense walks out"

Of course an elected Parliamentary Majority can enact the mandate on the basis on which it was elected. And can enforce laws/regulations per their interpretation. If the Opposition disagrees, kick up a storm in Parliament, and get voters on their side come next election.

That is the beauty of the Parliamentary system, over against the USA system prone to Congressional gridlock.

For the Opposition to denigrate that power under whatever narrative, then win a dam_n election.

The key point however....Is the electorate the next election......If the Opposition thinks the ruling majority is off on some power-trip, they forget the coming power-trip by the voters.

You may well be right but it's probable that this case is fairly simple in that a court order seems to have been broken that they couldn't do much else.
