The tax is payable on all income from commercial renting, whether the property is purchased or built. However if for example the owner is your wife, and she lives at the property, she is exempt.

Can somebody explain to me how a Thai person ,when buying land can prove the money does not come from overseas? Where does the Thai Gov. think it comes from? Thanks

Does not have to prove it doesn't come from overseas, only may have to show they are not a nominee of a foreigner. If the foreigner sticks with only a 30 year lease they are pretty much guaranteed security from a legal standpoint.

Thanks Dragonman. What really concerns me is the Thai wife has to say these funds were given to her BEFORE marriage. Ok she can say this ,but if looked into (as they are now doing with ltd cos) it can easily be proved untrue. Therefore ,as many ltd cos it would be a Sham. Do you see where I am coming from? So many uncertainties at present. I will not be buying untill next June. Just getting prepared.

Section 86, Land Code 1954; "aliens may acquire land in Thailand by virtue of a treaty". There has been no treaty since 1970.

pepi 1. The Thai wife does not have to say the funds were given to her before marriage, simpy that the funds were hers, OR they were given as a "gift" by her husband. For example birthday presents are not communal property. :o
