Former THAI president wins legal battle against his former boss

BANGKOK: -- The Central Labour Court today (Thursday) awarded former president of Thai Airways International Piyasvasti Amranand one million baht in compensation plus 7.5 percent interest for unfair termination of his employment by the national flag carrier.

Mr Piyasvasti filed a lawsuit against THAI board on June 21, 2012 accusing them of unfairly terminating his employment contract.

The court ruled that THAI board’s action was unfair and caused damages to Mr Piyasvasti.

Piyasvati’s lawyer, Mr Wirat Kalayasiri said that the compensation awarded to his client was not a substantial amount, the real purpose of taking the case to the court was to set a precedent that the government could not sack any employee at its free will.

He said he would appeal to the Supreme Labour Court on issues which were left out by the Central Labour Court.

Projected outcome: Dem Party MP makes complaint to Constitution Court that the sacking was political (even though the company is only 51% owned by the State and 7 out of 12 members of the board had been picked by abhisits government), in the interests of the country of course, nothing to do with being Plan C whistling.gif .

Constitution Court upholds complaint and begins investigation with a view to the possible impeachment of the PM.

Communication problems between Piyasvasti and the board were hampering the company’s effort to meet a profit target of 6 billion baht ($192 million) to 7 billion baht this year, Chairman Ampon Kittiampon said yesterday. Ampon confirmed that Piyasvasti passed the company’s annual performance evaluation.

“Some work has not been in line with the board’s policies,” Ampon said. He rejected suggestions that the move was politically motivated, saying seven of the 12 board members at yesterday’s meeting were appointed by the previous government.

“There is no political interference in this issue,” Prime Minister Yingluck Shinawatra told reporters today, adding that the government has no one in mind to replace Piyasvasti.

“I believe the board did this for the company’s benefit,” Finance Minister Kittiratt Na-Ranong said today. “I believe it’s not political interference because most of the board was appointed by the last government.”

THAI ordered to pay Piyasvasti Bt1m damages
The Nation

BANGKOK: -- The Labour Court Thursday ruled that board of Thai Airways International (THAI) pay a compensation of Bt1 million to axed former THAI president Piyasvasti Amranand.

In June 2012, Piyasvasti sued THAI in the Labour Court for injustice by terminating his employment a year before he had completed his four-year term on July 11, 2013. He had demanded that the company pay more than Bt10 million in compensation or reinstate him.

According to the court ruling Thursday, the termination of his contract by the board had damaged him. As such, the board has to pay compensation to him of Bt1 million, plus 7.5 per cent interest per annum on Bt1 million, from the date of the lawsuit on June 21, 2012. The court did not grant the other requests of the plaintiff.

Cheers for this visionary Thai commerce leader. He positioned the airline with vision, strategy, and efficiency during his watch. You can see the results of Thai Air now just a few days ago in the news.

sacked because his fight against internal corruption within Thai airways was stepping on some big toes. Now we can see what rampant corruption can do...........

“I just want the board to explain the reason,” Piyasvasti said at a media briefing yesterday. “It’s ambiguous. The performance of the company during my term has improved in every aspect and I passed the evaluation at 86 percent.” Piyasvasti oversaw a fleet modernization and cost cuts in 2009 that helped Thai Air rebound from its largest ever loss the year before to a record profit in 2010.........“There is no political interference in this issue,” Prime Minister Yingluck Shinawatra told reporters today, adding that the government has no one in mind to replace Piyasvasti. http://www.bloomberg.com/news/2012-05-21/fired-thai-air-ceo-blames-politics-over-business-southeast-asia.html

Thai Airways International (THAI) suffered heavy losses of about 13 billion last year as the airline board of directors on Friday approved the resignation of Ampon Kittiampon as chairman.
