Chavarin serves one year in prison with no suspension on amulet fraud

BANGKOK: -- Former Pheu Thai party's MP for Ratchaburi province, Pol Sub-Lt Chavarin Latthasaksiri was sentenced to serve one year in prison with no suspension of prison term after the Appeals Court found him guilty of fraud charge.

The ruling by the Appeals Court was seen to uphold earlier ruling by the Criminal Court that sentenced him to three years but commuted by one-third to two years in prison with no suspension after his confession was useful for the trial.

The former Ratchaburi MP appealed the ruling by the first court and sought lighter punishment and suspended jail-term.

However the Appeals Court agreed with the ruling of the first court because the offence he committed was serious threat to societies and no suspended prison term ruled by the first court was appropriate.

However the Appeals Court said that as his crimes had not caused widespread damages to the people but only two persons who had already been refunded by the defendant, the two-year prison term ruled by the first court is too heavy.

It then reversed the prison term to one year and six months instead.

However his confession was useful, the Appeals Court then commuted the prison term by one third to one year in prison with no suspended term.

Pol Sub-Lt Chavarin was prosecuted after he advertised sales of “Jatukam Rammatap” amulets between May and June 2006 on Thai Rath daily newspapers at 199 baht each for the 40,000 amulets made. He claimed all the amulets had been processed in religious ceremony held at the Temple of the Emerald Buddha, and the City Pillar.

But it turned out that his claim of religious ceremonies at the two places was just a lie.

His advertisement, however, had convinced one person to pay 1,791 baht, and another 1,194 baht to place order for the amulets.

Any chance he'll be banged up together with another politician convicted of fraud recently ?

 

Fraud is fraud and a conviction is a conviction and an appeals court decision is an appeals court decision and bail refused should be bail refused.

 

By rights the anti-Thaksin Sondhi and the pro-Thaksin Chavarin should be cellmates as a prison sentence is a prison sentence.

Sadly, unearned deference rules in the Land of Smiles, as the family name, family fortune and business, and hierarchical rank trumps all.

...the corruption stems from the backing of The Amulet organization....a Thai friend told me...

 

...He said that this big Amulet Organization has been put in the middle of a 30 Million Baht Fraud perpetrated against King Power as well....

 

....(I don't know if this was covered in English or foreign media...I had not heard of it myself)...

 

...or is this the same case.....???

 

...he says the other side of the coin is.... the same people deemed his Original Amulets as 'Fakes'....so that they could acquire them for 'peanuts'....

 

...who knows...especially if you cannot trust the 'experts'......

Whereas drink driving is a minor infringement and never hurts anybody (well, only the people they kill and maim)

 

Why do you say that and what's it got to do with fraud cases?

Thailand the hub of inconsistent court rulings? Maybe the powers that be should get together and formulate suitable sentences /penalties for crimes and then uniformly apply them. Separation of criminal and civil rules; jail time should not be awarded for civil disputes or defamation .
