Hi,

Me and my Thai gf are now together for about two years. She is still living in Thailand , but i would like her to live AND work in the UK in the near future. a couple of questions;

A - Do i need to get married to her if she will be living and working in the UK

B - What kind of visa do i need to arrange for her in order for her to work here.

If you want your g/f to live and work in the UK, there are only a few options open:

1. Unmarried partner visa - you need to have been living together in a relationship akin to marriage for at least 2 years and meet the accommodation, financial, and intention to stay together criteria of the rules.

2. Fiancée/spouse visa - you will need to get married either in Thailand or the UK and additionally meet the accommodation etc. criteria;

3. Highly Skilled Migrant Programme/Work Permit - your g/f can come and work in the UK if she has the requisite educational qualifications/work experience or is offered a job which otherwise can't be filled from labour within the EEA.

Hi Scouser,

Thanks for your reply. By the looks of it i will have to get married to her. As i dont think i would

qualify for the unmarried partner visa as we have not been living together at the moment.

Can she just stay umarried in the UK for 6 months and still working. And then renew her visa

for another 6 months. As she wanted to apply for a job with an airline and they ask that person

need to have the legal right to live and work in the UK.

If she is considering a Fiancé visa then paragraph 291 of the immigration rules would also apply.

Leave to enter as a fiancé(e) or proposed civil partner

291. A person seeking leave to enter the United Kingdom as a fiancé(e) or proposed civil partner may be admitted, with a prohibition on employment, for a period not exceeding 6 months to enable the marriage to take place provided a valid United Kingdom entry clearance for entry in this capacity is produced to the Immigration Officer on arrival.

However, as Scouse said, if obtains a spouse visa or entry for employment then she can also work.

Further to Vinny's reply.

A fiance visa cannot be renewed, except in the most exceptional of circumstances. The marriage being postponed due to serious illness, for example.

Basically, if you don't marry within the 6 months then she will have to return to Thailand and apply again. However, in order to get a second fiance visa she will have to show good reason why the marriage has not already taken place and satisfactory evidence that it will take place in the near future.

As she wanted to apply for a job with an airline and they ask that person need to have the legal right to live and work in the UK.
Are you asking because you both are serious about each other and want to spend the rest of your lives together?

Or are you simply trying to find a way of her getting that airline job?
