hi

MY fiance came to uk in feb on a fiancee visa and last week got married in the uk!!

Now im not sure what to do next do I apply for a settlement visa and will this take a long time as her current fiancee visa is due to expiry mid august?

any advise would be helpful please.

What she does now is apply for Further Leave to Remain, using form FLR(M) which you can download from here. Most of your questions should be answered by the guidance notes that come with the form, but please ask here if you're not sure of anything.

FLR is straightforward to apply for, as basically all you have to do is show that the marriage has taken place. You should do it now, and not wait until her fiance visa expires.

It costs £335 by post, or £500 in person.

Two years after getting FLR she will need to apply for Indefinite Leave to Remain. You will need to show that the relationship is still in existence and you have been living together for the whole 2 year period. To do this you will need to provide letters, utility bills etc. addressed to both of you covering the 2 years, so it's worth getting her name put on your bills etc.

I would add to the above that in addition to showing the marriage has taken place you also need to show (again) that you can financially support her as she will be unable to work (if indeed she is intending to) until she gets her FLR granted.

So 3 months bank statements/savings accounts and wage slips are required (unless your savings are large enough to make wage slips unneccessary or you are retired). No photocopies.

Otherwise straigtforward as stated . A friend of mine applied 3 weeks ago and got the FLR back last week . My partner has also just applied and we are waiting.

How do I change her name if she wishes? what are the implications of this when we go back to thailand for holiday or long term in the future. What are the implications for her if she changes her name and also obtains a British Passport?

Having married in the UK, her name is now changed, although she can retain her maiden name if she wishes. You don't have to do anything else as far as the UK is concerned, except tell people.

To change the name in her passport you will need to contact the RTE in Kensington.

To change the name on her ID card she will need to visit an Ampur next time she is in Thailand.

Changing her name and taking out British citizenship, when qualified, will have no effect on her Thai citizenship nor her rights as same.
